Subject: Request for
convening supplementary DPC of PS Group B cadre for the year 2015-16.
Respected Madam,
Your kind attention is invited to Association’s
letter No. CHQ/AIAIASP/PS Gr. B/DPC-AP/2014 dated 11.1.2016 (copy enclosed) vide
which it was requested to convene review / supplementary DPC for promotion to the cadre of PS Gr. B for the year
2015-16. But nothing has been heard in
this regard so far.
It is to bring to your kind notice that
DPC for promotion to the cadre of JTS Gr. A for the year 2015-16 was convened prior
to holding of DPC for the promotion to the cadre of PS Gr. B for the year
2015-16. Resultantly, 36 officers of PS Gr. B cadre were promoted to JTS Gr A vide
memo No. 4-2/2015-SPG dated 31/12/2015. Mean
while 7 officers declined their promotion in PS Gr B cadre and Directorate
accepted their declination vide memo. No. 9-03/2016-SPG dated 28/1/2016. Thus,
43 residual vacancies are available for convening supplementary DPC in PS Gr. B
cadre for the year 2015-16. It is worthwhile to mention here that last year
also such type of orders were issued followed by supplementary DPC for the
promotion to the cadre of PS Gr.B. Consequently, 34 posts of PS Gr B cadre was
filled vide Memo No.9-25/2014-SPG dated 14/7/2015.
It is significant
to mention that out of 122 officers promoted vide memo dated 10.11.2015, 31
officers promoted to PS Gr. B for the year 2014-15/supplementary DPC for the
year 2013-14 and declined their regular promotion shall also have been selected
against the vacancy year 2015-16. These 31 officers will be promoted only after
the expiry of their debarment period. Willingness / un-willingness of such
officers have not been obtained by Directorate till date.
Supplementary DPC of the left out vacancies from
the extended zone of consideration is a part of main DPC and should be convened
immediate after completion of one month against left out vacancies so as the
officers in the extended zone may not be deprived of their legitimate right and
benefits. It is also the settled law that if the consideration for promotion
gets delayed for no fault of the employee who is otherwise found fit for
promotion in that vacancy year itself, then natural justice would require grant
of the benefit of promotion with retrospective effect from the date of
occurrence of the vacancy. Even now, no action to convene supplementary DPC has
been initiated.
In view of the above, your honour is requested to convene the
supplementary DPC for the vacancies 2015-16 only after 31 officers whose
debarment period is over or after receipt of declination of promotion if any
from them.
We hope that an early action will be
taken in this issue.
