Union Cabinet approves ordinance to impose penalty for holding old notes

NEW DELHI: The Union Cabinet on Wednesday approved promulgation of an ordinance to impose a penalty, including a jail term, for possession of the scrapped 500 and 1,000 rupee notes+ beyond a cut-off. 

The Cabinet headed by Prime Minister Narendra Modi also approved an ordinance to amend the RBI Act to extinguish the liability of the government and the central bank on the demonetised high-denomination notes to prevent future litigations.

Official sources said the ordinance has been cleared, but did not say if the penal provisions would apply for holding the junked currency after the 50-day window to deposit them in banks ends as of December 30 or after March 31, till which time deposit of old currency notes at specified branches of the Reserve Bank after submitting a declaration form is open. The ordinance on denotification of Rs 500 and Rs 1000 notes has been sent to President Pranab Mukherjee for his assent. The penalty for holding old currency in excess of 10 notes may include financial fines and a jail term of up to 4 years in certain cases.

After December 31, the government through a separate notification and clarification will specify cases eligible to get the banned currency deposited in specified branches of the RBI. 

While announcing the demonetisation of the old currency on November 8, the government had allowed holders to either exchange them or deposit in bank and post office accounts. While the facility to exchange the old notes has since been withdrawn, depositors have time till Friday to deposit the holding in their accounts.

The ordinance is expected to be replaced by a law in the Budget session of Parliament, likely to begin by the end of January.
Of the Rs 15.4 lakh crore worth of currency that was scrapped, Rs 14 lakh crore has been deposited in banks or exchanged.

Fresh guidelines on Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 issued by DoPT

WCD Ministry will hold consultations on a regular basis on issues pertaining to the Act: Smt Maneka Sanjay Gandhi

The Minister for Women and Child Development, Smt. Maneka Sanjay Gandhi, had held a review meeting on implementation of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 on 26.10.2016. During the meeting, some cases of sexual harassment pending with certain ministries/ departments were also examined. On the basis of the discussions, it was decided that DoPT will issue fresh instructions so that some of the issues can be suitably addressed.

On the basis of the decisions taken, DoPT has issued fresh guidelines regarding Sexual Harassment of Women at Workplace vide their Office Memorandum dated 22.12.2016. According to the O.M., following have to be observed by the ministries/departments and Internal Complaints Committees:

(i)                  Brief details of the implementation of the Sexual Harassment of Women at Workplace Act including the number of cases received and disposed shall form a part of the Annual Report of all ministries/ departments and authorities there under.

(ii)                  The enquiry of cases must be completed within 30 days and under any circumstances within 90 days from the date of the complaint.

(iii)                The ministries/ departments etc. have to keep a watch on the complainant so as to ensure that she is not victimized in any manner because of her having filed the complaint. The aggrieved woman has been given further option to send representation to the Secretary or head of the organization in case she feels that she is being victimized because of her complaint. The concerned authority will be required to dispose of this complaint within 15 days.

(iv)               All ministries/ departments etc. are now required to submit a monthly progress report to the Ministry of Women and Child Development so that the progress can be monitored.

Smt. Maneka Sanjay Gandhi, while appreciating DoPT for having quickly issued the guidelines, stated that the WCD Ministry shall continue to work on issues related to sexual harassment of women at workplace and she will be holding further consultations to see if there are any other areas which need to be looked into. The WCD Ministry will be coming out with a comprehensive plan to train the heads of Internal Complaint Committee under the Central Government Ministries/ Departments, the Minister added.

Central Government makes it illegal to hold old notes post March 31

The Cabinet on Wednesday approved promulgation of an ordinance to extinguish Reserve Bank of India's liability towards the Rs 500 and Rs 1000 notes that ceased to be a legal tender from November 8.

This ordinance would provide the legislative backing for the demonetisation exercise.

It will make necessary changes to the RBI Act to allow for extinguishing central bank's liability with regard to issued currency that has been cancelled.

All notes carry RBI's promise to pay the bearer the amount of the value of the currency and it requires a legal change to end this liability.

The ordinance also seeks to make possession of more than ten notes of Rs 500 or Rs 1000 a penal offence attracting a monetary fine that could Rs 10,000 or five times the cash held, whichever is higher, a government official said.

The ordinance will have to be sent to the President and after his assent will come into force.

Fresh guidelines would be issued for exchange of notes at RBI counters post December 30. Notes will be allowed to be deposited with select branches of RBI till March 31 in exceptional circumstances.

Finance Minister Arun Jaitley said that government's bid to go cashless means less cash not no cash.

Speaking at the event Finance Minister Arun jaitley said that Aadhar based payment is for people who don't have cards or mobile phones, they only need thumb print for transactions.

Addressing the Event IT minister Ravishankar Prasad said that 36 crore bank accounts have been linked with aadhaar and more that 36,000 crore rupees have been saved by controlling subsidy leakages.

Under Lucky Grahak Yojana Daily reward of Rs 1000 will be given to 15,000 lucky Consumers for a period of 100 days.

Weekly prizes worth Rs 1 lakh, Rs 10,000 and Rs. 5000 for Consumers who use the alternate modes of digital Payments.

3 Mega Prizes for consumers worth Rs 1 cr, 50 lakh, 25 lakh will be announced on 14th April, 2017 Weekly prizes worth Rs. 50,000, Rs 5,000 and Rs. 2,500 will be given to merchants who accepts online transactions.

3 Mega Prizes for merchants worth Rs 50 lakhs, 25 lakh, 12 lakh for digital transactions will be announced onm 14th April 2017.

The schemes will be implemented by National Payments Corporation of India.
Only transactions made using RuPay cards, USSD, UPI and Aadhaar are eligible for these schemes --Both schemes will cover small transactions between Rs 50 and Rs 3000 to encourage every section of the society to move to digital payments.

Expenditure of the scheme is estimated to be around Rs 340 crore.

The winners shall be identified through a random draw of the eligible Transaction IDs which are generated automatically as soon as the transaction is completed by a software developed by National payments corporation of India.

State Bank of India will grant special leave of two days to its employees as reward for having taken additional stress since November 8 when demonetisation was announced.

Employees would be able to avail this leave any time until March 2018, said SBI Chairman Arundhati Bhattacharya in Mumbai on Wednesday.

Centre releases special stamp on freedom fighter “Shri Gaya Prasad Katiyar” and a set of eight Commemorative Postage Stamps on “Personalities Series: Bihar” & a stamp on “Hardayal Municipal Heritage Public Library” 

Department of Posts, Ministry of Communications has brought out a Special Cover on freedom fighter “Shri Gaya Prasad Katiyar” and a set of eight Commemorative Postage Stamps on “Personalities Series: Bihar” & a stamp on “Hardayal Municipal Heritage Public Library”.

 A special cover on “Shri Gaya Prasad Katiyar” was released by Smt Anupriya Patel, Hon’ble Minister of State for Health & Family Welfare and Commemorative Postage Stamps on “Personalities Series: Bihar” and “Hardayal Municipal Heritage Public Library” were releasedon 26th December, 2016.

The Department has commemorated great deeds and achievements of following eight personalities of Bihar by releasing stamps on them:

“Hardayal Municipal Public Library” is situated in the heart of Chandni Chowk and is one of the very few oldest buildings that have been able to withstand the onslaught of modern times. The library was set up in 1862. It has a unique collection of more than 1,70,000 books in Hindi, English, Urdu, Arabic, Persian and Sanskrit. This is one of the few Libraries in the world with a collection of at least 8,000 rare books.

Gaya Prasad Katiyar was one of the most dedicated soldiers of India’s freedom struggle. Gaya Prasad Katiyar was born at Jagadishpur (UP). He joined Hindustan Socialist Republican Association in 1925 and got connected with Chandra Shekhar Azad and Bhagat Singh. Later he participated on Lahore Conspiracy Case and was arrested from Saharanpur in 1929. He joined the hunger strike at Lahore Jail with his co prisoners. Later he was transported to Cellular jail in Andaman and again he participated on hunger strike there. He was repatriated in 1937 but again arrested and transported to cellular jail from where he was released in 1946.

7th Pay Commission: Demonetisation a blessing in disguise for central government employees

New Delhi, Dec 27: Central government employees, who have been waiting for higher allowances as the recommendations of the 7th Pay Commission, should not be worried as the government will be in a position to implement the 7th CPC recommendations, thanks to demonetisation. The demonetisation of old Rs 500 and Rs 1000 currency notes that caused cash shortage has made central government employees little anxious, but report by BofA Merrill Lynch Global Research and statement of Reserve Bank of India Governor Urjit Patel will bring smile on their faces.

According to the BofA Merrill Lynch report, Pradhan Mantri Garib Kalyan Yojana, 2016 will bring huge amount in government’s pocket to offset the financial implication of implementing the 7th Pay Commission recommendations. The Pradhan Mantri Garib Kalyan Yojana was announced after demonetisation for declaring unaccounted income.

“The Government announced that the second income disclosure scheme (IDS II) will run till March 31. We continue to estimate that it will net the fisc about Rs1000bn/0.7% of GDP of additional taxes. This should allow Finance Minister Jaitley to hold the FY18 fiscal deficit at 3.5% of GDP – same as FY17’s – and at the same time fund the 7th Pay Commission and recapitalize PSU banks, without cutting back on public capex,” BofA Merrill Lynch said in a note. Earlier, the RBI had made clear that the implementation of the 7th Pay Commission recommendations for central government employees won’t have an inflationary impact.
Earlier we reported that the central government employees will have to wait til March, 2017 to get their higher allowances under the 7th Pay Commission recommendations. Centre is planning to pay higher allowances without arrears. Sources in the Finance Ministry also said the Centre is considering to hike higher allowances for its employees. However there is no report about when the government will start paying higher allowances as recommended by the 7th Central Pay Commission.

The issue of higher allowances has been referred to the ‘Committee on Allowances’. The committee is yet to submit its report. Until acceptance of higher allowances, under 7th Pay Commission, the allowances are now paid according to the 6th Pay Commission recommendations.

Commemorative Postage Stamp released on Samrat Vikramadiya on 22-12-2016

Vikramaditya was a legendary emperor of ancient India. He is characterised as the ideal king, known for his generosity, courage, and patronage of scholars. There are hundreds of legends about Vikramaditya, including the ones in Baital Pachisi and Singhasan Battisi. Most of the legends present him as a universal ruler with his capital at Ujjain (Pataliputra or Pratishthana in a few stories).

According to the popular tradition, Vikramaditya started the Vikrama Samvat era in 57 BCE, after defeating the Shakas. For this reason, those who believe him to be based on a distinct historical figure place him around the 1st century BCE. However, this era is mentioned as "Vikrama Samvat" only after the 9th century CE. Other scholars argue that Vikramaditya is a mythical character as several of the legends about him are fantastic in nature. "Vikramaditya" was a common title adopted by several Indian kings, and it is possible that the various Vikramaditya legends are embellished accounts of different kings, particularly Chandragupta II.

Many Vikramaditya legends, especially the Jain ones, associate him with another legendary king—Shalivahana of Pratishthana. In some of them, he is defeated by Shalivahana (who establishes the Shalivahana era) while in others, he is an ancestor of Shalivahana; a few legends also apply the title of Vikramaditya to the king of Pratishthana. The political rivalry between the two kings is sometimes also extended to patronage of language, with Vikramaditya supporting Sanskrit and Shalivahana supporting Prakrit.

Bonanza for Central government employees: 7th Pay Commission recommendations rolled out

New Delhi: The government had in January 2016 had set up the high-powered panel to process the recommendations of the 7th Pay Commission which will have bearing on the remuneration of nearly 50 lakh central government employees and 58 lakh pensioners.

The Union Cabinet on June 29 cleared the recommendations of the 7th Pay Commission headed by AK Mathur in respect of the hike in basic pay and pension. However, the decision on 7th Pay Commission suggestions relating to allowances had been referred to a Committee headed by the Finance Secretary.
The Committee will complete its work in a time bound manner and submit its reports within a period of 4 months. Till a final decision, all existing allowances will continue to be paid at the existing rates.

The 7th Pay Commission examined a total of 196 existing allowances and, by way of rationalization, recommended abolition of 51 allowances and subsuming of 37 allowances. Given the significant changes in the existing provisions for allowances which may have wide ranging implications, the Cabinet decided to constitute a Committee headed by Finance Secretary for further examination of the recommendations of 7th CPC on allowances.

On 29 June 2016, Government accepted the recommendation of 7th Pay Commission Report with meager increase in salary of 14 percent after six month of intense evaluation and successive discussions. The Finance Minister of India claimed it historical increase of salaries due to little knowledge of Sixth Pay Commission.

The new scales of pay provide for entry-level basic are now up from Rs 7,000 per month to Rs 18,000, while at the highest level i.e. Secretary, it would go up from Rs 90,000 to Rs 2.5 lakh. For Class 1 officers, the starting salary will be Rs 56,100.

The recommendations will benefit over 1 crore employees. This includes over 47 lakh central government employees and 53 lakh pensioners, of which 14 lakh employees and 18 lakh pensioners are from the defence forces.

• Housing loan allowance hiked from Rs 7.5 lakh to Rs 25 lakh

• Based on minimum pay, fitment factor of 2.57 approved for revising pay of all employees uniformly across all level
• Minimum pay fixed at Rs 18,000 per month; maximum pay at Rs 2.25 lakh
• The Cabinet approval will benefit nearly 50 lakh central government employees and 58 lakh pensioners
• Pay hike to be implemented from January 1, 2016
• Budgetary allocation

While the Budget for 2016-17 fiscal did not provide an explicit provision for implementation of the 7th Pay Commission, the government had said the once-in-a-decade pay hike for government employees has been built in as interim allocation for different ministries. Around Rs 70,000 crore has been provisioned for it.
