CHQ NEWS LETTER DATED 17.9.2009

1. DPC for promotion to PS Group B is held up for want of few more CRs from Maharashtra, Tamilnadu and U.P Circles. Circle Secretaries may please contact Circle offices and arrange to send the remaining CRs early.
2. GDS Committee Report is coming for discussion before the Cabinet Committee today (17.9.2009) and the Committee is likely to nod its approval for implementation. Implementation orders may be issued any time within a week.
3. Central Working Committee Meeting under the Chairmanship of Shri.S.B.Mahapatra, our President was successfully held at Pushkar, Rajasthan on 01 & 02.8.09. A large number of members from 15 Circles participated in the deliberation. Minutes of the CWC is being issued separately. We submit our sincere thanks to Shri. Hari Prasad Sharma outgoing Circle Secretary Rajasthan (now promoted to Gr B) and Shir. Atma Ram ASP for their hard work and hospitality during CWC.
4. Circle Conference of Rajasthan also was held side by side at Pushkar on 02.8.09. Shri. Atma Ram ASP Ajmer R.O and Bhupendra Parashar IP(C) C.O Jaipur have been elected as Circle President and Circle Secretary respectively. We congratulate them for a successful tenure.
5. Delhi Circle will hold the next All India Conference at New Delhi during first week of April 2010. Exact dates of the Conference will be announced very soon. Reception Committee under the leadership of Shri. Roop Chand AGS, Shri. R.D.Sharma CS Delhi Circle and Shri. D.C.Sharma Secretary Reception Committee, 36th All India Conference is making elaborate arrangements for the successful conduct of the conference. Donation tickets are being despatched to all Circle Secretaries and CHQ Office bearers. All are requested to extend their full support and co-operation in raising fund the conference.
6. A new and peculiar problem has arisen in Maharashtra Circle. ASPs in Goa Region have been issued with Rotational Transfer order on completion of their normal tenure. The order was issued during May 2009. But till date the ASPs are not relieved to join their new posts on the plea that they have not achieved the BD target. Where ever we go, whether it is old post or new post targets are kept ready and waiting for us. It has become our bounden duty to achieve the target. But not relieving an IP or ASP on transfer on this ground is too much. Target can be achieved when the staff are happy. We depend on GDS to achieve any target. We cannot do business without their co-operation in the rural area. While pay and perks of regular employees have been enhanced, the poor GDS are left in lurch. Their long pending grievances regarding revision of their allowances are yet to be settled by the government. General Secretary called on DG Posts on 16.9.09 and brought this matter to the notice of DG. DG Posts was requested to settle the GDS problem first and also help to relieve the ASPs in Goa Region. DG assured to issue positive instructions to chief PMG.
7. Grade Pay of IP/ASP/PS Gr B is still pending with the Department. Some quarries have been raised by IFA. It is yet to be cleared by concerned Section. GS discussed the matter with DG Posts and Madam is in favour of our demand. GS will pursue further and exert pressure on this issue.
8. Circle Working Committee meeting of Tamil Nadu Circle will be held at Pollachi on 24th September 2009.
9. Circle Working Committee Meeting of Madhya Pradesh Circle will be held on 02 October 2009 at Hoshangabad.
10. A general body meeting has been arranged by Kerala Circle at Calicut on 03 October 2009. General Secretary will participate in the meeting.
11. Public Services International organized Workshop on “Trade Union Rights and use of ILO mechanism” at Ooty, Madurai & Thanjavur for the benefit of various trade unions of different public services in the state of Tamilnadu. From our Association 20 members participated.
12. Even after 20 years the Second Cadre Review was not implemented by the Department. A decision was taken in the CWC Pushkar to file two different Writ Petitions before Hon’ble High Court of Madras and Hon’ble High Court of Punjab and Haryana at Chandigarh by the respective Circle Branch of our Association. It is under preparation. Shri. P.R.Satyanarayanan our former President will help us.

IPO EXAMINATION 2008 RESULT - AN ANALYSIS

Directorate declared results on 18.9.2009 vide Memo No. A-34O1 3/Ol /2OO9-DE. The examination was held on 5th, 6th and 7th November 2008 and the result declared after 10 months.

As per the result, out of 207 vacancies, only 93 candidates came successful in the merit list. 114 vacancies are still available (in other Circles) and only 108 candidates are qualified in the examination.

PAYMENT OF DA TO CENTRAL GOVT. EMPLOYEES W.E.F 1.7.2009

Sub : Payment of DA to Central Government employees - Revised rates effective from 1.7.2009

The undersigned is directed to refer to this Ministry's Office Memorandum No 1(1)/(2009)-E-II (B) dated 13.3.2009, on the subject mentioned above and to state that the President is pleased to decide that the DA payable to Central Government employees shall be enhanced from the existing rate of 22% to 27% w.e.f 1.7.2009.

2. The provisions contained in paras 3,4 and 5 of this Ministry;s OM No 1(3)/2008 -E-II (B) dated 29.8.2008, shall continued to be applicable while regulating DA under these orders.

3. The addtional installment of DA paybale under these orders shall be paid in cash to all Central Government employees.

4. These orders shall also apply to all the Civilian employees paid from Defence Service Estimates and the expenditure will be chargeable to the relevant head of the Defence Service Estimates. In regard to Armed Forces personnel and Railway employees separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the CAG of India.

MACPS ORDERS ISSUED ON 18.9.2009

Sub : Modified Assured Career Progression Scheme (MACPS) for the Central Government Civilian Employees.

The Sixth Central Pay Commission vide Para 6.1.15 of its report has recommended Modified Assured Career Progression Scheme (MACPS). The Government has considered the recommendatations of the Sixth Central Payh Commission on the Assured Career Progression and accepted the same with further modification to grant three financial upgradations under the revised Scheme at intervals of 10,20 and 30 years of continuous regular service and issued orders vide Ministry of Personnel, Public Grievances and Pensions (Department of Personnel & Training) OM No 35034/3/2008-Estt. (D) dated 19.5.2009. The Scheme is known as "MODIFIED ASSURED CAREER PROGRESSION SCHEME (MACPS) FOR THE CENTRAL GOVERNMENT CIVILIAN EMPLOYEES" and which has come into operation w.e.f. 01-09-2008.

2. This scheme is in supersession of previous ACP Scheme and clarifications issued there under. The scheme shall be applicable to all regularly appointed Group "A", "B", "C" Central Government Civilian Employees except officers of the Organised Group "A" service. The status of Group D employees cease and be treated as Group C. Multi-Skilled employees on their completion of prescribed training. Casual employees, including those granted 'temporary status' and employees appointed in the Central Government only on adhoc or contract basis shall not qualify for benefits under the aforesaid Scheme.

3. Department of Posts has its own scheme of Time Bound One Promotion (TBOP)/Biennial Cadre Review (BCR) for its employees. . Time Bound One Promotion was introduced w.e.f. 30.11.1983 vide letter No 31-26/83-PE.I dated 17/12/1983. Biennial Cadre Review was introduced w.e.f. 01.10.1991 vide Directorate Memo No 22-1/89-PE-1 dated 11.10.1991. The scheme was further extended to certain other categories of employees from different dates.

4. The scheme of TBOP introduced w.e.f 30.11.1983 and the BCR introduced w.e.f. 01.10.1991 and extended to other categories of staff on subsequent dates shall stand withdrawn w.e.f. 01-09-2008.

5. The postal Federations have given their consent for switching over to the MACPS. As regards drivers, they are governed by a structured promotion scheme & as the scheme is considered beneficial to this category of staff, the Postal Federations have requested to retain the existing structured scheme. It has been decided to continue to the existing structured promotion scheme for drivers.

6. On grant of financial upgradation under the scheme, there shall be no change in the designation, classification or higher status. However, financial and certain other benefits which are linked to the pay drawn by an employee such as HBA, Allotment of Government Accommodation shall be permitted.

7. The salient features of the MACP are given in Annexure- 1.

8. Before initiating action for placing the eligible employees under the MACPS, action may be taken to finalise all TBOP/BCR placements due for the period till 31.08.2008 by conducting meetings of Screening Committee and issuing necessary orders.

9. Screening Committees shall be constituted in each Division/Region/Circle to consider the cases of different levels for grant of financial upgradations under the MACP Scheme. The Screening Committees shall consist of Chairperson and two members. The members of the Committee shall comprise officers holding posts which are at least one level above the grade in which the MACP is to be considered and not below the rank of Under Secretary or equivalent in PB-3 with GP of Rs 6600/-. The Chairperson should generally be of a grade above the members of Committee. The Screening Committees should keep in view of the benchmark prescribed for financial upgradations.

10. The recommendations of the Screening Committee shall be placed before the DPS/Director Accounts Postal/Head of the Region/Circle or Organisation/competent authority as the case may be for approval.

11. In order to prevent undue strain on the administrative machinery, the Screening Committee shall follow a time-schedule and meet twice in a financial year - preferably in the first week of Januay and first week of July of a year for advance processing of the cases maturing in that half. Accordingly, cases meturing during the fist-half (April-September) of a particular financial year shall be taken up for consideration of the Screening Committee meeting in the first week of January. Similarly, the Screening Committee meeting in the first week of July of the financial year shall process the cases that would be maturing during the second-half (October-March) of the same finanancial year.

12. Any interpretation/clarification or doubt as to the scope and mearning of the provisions of MACPS given by the Dept of Personnel and Training (Est-D) will be further communicated by the Establishment Division of the Directorate. The Scheme would be operational w.e.f. 01.09.2008 and financial upgradations as per the provisions of the earlier ACP Scheme (of August, 1999)/TBOP/BCR Schemes of the Department of Posts would be granted till 31.08.2008

13. No stepping up of pay in the pay band or GP would be admissible with regard to junior getting more pay than the senior on account of pay fixation under MACP Scheme.

14. It is clarified that no past cases would be re-opened. Further, while implementng the MACP Scheme, the differences in pay scales on account of grant of financial upgradsation under the old ACP Scheme (of August 1999)/TBOP/BCR Schemes of Department of Posts and under the MACP Scheme within the same cadre shall not be construed as an anomoly.

15. It is requested that the OM may be circulated to all concerned and immediate action may be taken to complete the entire process as indicated in the OM.

10% Cut imposed in the non - plan expenditure under the following heads:-

(a) Domestic and Foreign Travel expenses. (b) Publications (c) Professional Services (d) Advertising and Publicity (e) Office expenses (f) POL (except for security related requirement) (g) Other administrative expenses

Remaining portin of non-plan expenditure will be subjected to a mandatory 5% cut excluding interest payments, repayment of debt, Defence Capital, Salaries, Pension and the Finance commission grants to the States.

PAYMENT OF HONORARIUM TO INQUIRY/PRESENTING OFFICERS

The undersigned is directed to refer to this department's OM no 134/4/99-AVD I dated 29th June 2001 and 7th  April 2003 on the subject mentioned above and to say that the rates of honorarium payable to the IO//PO in the case of departmental inquiries were last revised vide OM dated 29th June 2001 in the case of serving Government Servants functioning as part time IO/PO and vide OM dated 7th April 2003 in the case of retired Govt Servants functioning as IO.

2. The existing rates of honorarium as prescribed in the aforesaid OM was reviewed in consultation with the Ministry of Finance. As a result of review, it has been decided to revise the existing rates of the honorarium, payable, to 10/PO. The rates of honorarium as revised are indicated in the table below:-

Payment of second instalment of arrears on account of Sixth Central Pay Commission Recommendataions.

Sub : Payment of second instalment of arrears on account of Sixth Central Pay Commission Recommendataions.

As communicated vide this Department's Resolution No.l/l/2008-IC dated 29th August, 2008, the Government had decided that the arrears on account of implementation of Sixth Central Pay Commission's recommendations will be paid in cash in two instalments - first instalment of 40% during the year 2008-09 and the remaining 60% in the financial year 2009-10. The first instalment bas already been paid in 2008-09. It has now been decided that the remaining 60% of arrears may now be paid to the concerned Government servants.

2. Further, as already stipulated vide this Department's O.M. No 1 (2)/ EV/2008 dated 17th August, 2009, in the case of post-Ol.01.2004 entrants into the Central Government, the second instalment of arrears may be released only after individual application forms for registration to the New Pension Scheme have been obtained by the DDO/PAO from the concerned Government servant.

3. As in the case of the first instalment of arrears, Government servants will be permitted to deposit their arrears in their GPF Accounts. Though not mandated, Government servants are encouraged to deposit their arrears in their GPF accounts.

DOCUMENTS FOR DATE OF BIRTH FOR PENSIONERS - CLARIFICATION ISSUED BY DEPT OF PENSION

Sub : Implementation of Government's decision on the recommendations of the Sixth Central Pay Commission - Revision of Pension of pre-2006 pensioners/family pensioners etc

The undersigned is directed to say that in this Departments' OM of even Number dated 21.5.2009, it was provided that the following documents would be accepted as proof of date of birth/age for payment of additional pension/family pension on completion of 80 years and above:

(i) Pan Card

(ii) Matriculation certificate (containing the information regarding date of birth )

(iii) Passport

(iv) CGHS Card

(v) Driving licence (if contains date of birth)

2. The matter has been examined further. Considering the difficulay in producting any of the above mentioned documents as proof of age by the old pensioners, particularly those in the rural areas, it has been decided that the Voters' ID may also be accepted as proof of date of birth/age for payment of additonal pension/family pension on completion of 80 years and above subject to the following conditions:

3. The other conditions for acceptance of the documents,as mentioned in the OM dated 21.5.2009, will remain the same.

4. Some doubts have been expressed regarding the date from which the additional pension is to be made effective. In this connection, attention is invited to the clarifications issued vide this Department's OM of even No dated 3.10.2008. It is re-iterated that the additional quantum of pension/family pension, would be admissible from the 1st day of the month in which the date of birth falls, only on completion of the age of 80 years, 85 years, etc (and not in the beginning of the 80th year, 85th year, etc). All references/representations received in this respect stand disposed off accordingly.

Illustration : If a pensioner/family pensioner's date of birth is 26.1.1930, then he/she will be entitled to the additional quantum of pension on completion of 80 years of age w.e.f. 1.1.2010.

BIG TAX CUT COMING YOUR WAY

NEW DELHI: Finance minister Pranab Mukherjee on Wednesday unveiled a roadmap for reforms in direct taxes that promises to drastically cut the tax liability of most individuals by considerably raising tax slabs. The new direct taxes code, proposed to be implemented from April 2011, aims to moderate effective tax rates in the hope that this will encourage more people to pay up.

The most significant changes proposed are in personal income tax, which could lead to tax savings of up to Rs 2.67 lakh each year. The 10% tax rate, currently applicable for incomes between Rs 1.6 lakh and Rs 3 lakh, will apply to incomes between Rs 1.6 lakh and Rs 10 lakh, which means those with incomes between Rs 3 lakh and Rs 10 lakh could save up to Rs 1.17 lakh from their annual tax liability.

The next slab of 20% would be applicable for incomes between Rs 10 lakh and Rs 25 lakh instead of — as is currently — between Rs 3 lakh and Rs 5 lakh and the 30% slab would be for incomes exceeding Rs 25 lakh, which now kicks in at Rs 5 lakh. The benefits to taxpayers with annual incomes of Rs 25 lakh or more as a result of these changes would be about Rs 2.67 lakh per annum.

As the icing on the cake, the new code proposes to allow for exemptions on savings up to Rs 3 lakh rather than the Rs 1 lakh now allowed under Section 80C of the I-T Act. There is a catch, though. There is no mention of any exemption for housing loans, though the exemption for higher educational loans will stay.

The exemption limit at which taxes kick in will continue to be higher for women and senior citizens. For women, their tax meter will start ticking when their income exceeds Rs 1.9 lakh per annum, whereas senior citizens will have to pay tax only if they earn more than Rs 2.4 lakh a year.

A change that could be problematic for many individuals is in the treatment of post-retirement benefits like provident fund. The adoption of the EET (exempt-exempt-tax) method will mean that any withdrawal of money from your PF account, for whatever reason, will attract a tax since the amount withdrawn will be treated as part of your income for that year. This will, however, apply only to amounts that accrue April 2011 onwards.

Like personal taxes, the corporate tax rate too is to be cut from the existing 30% (excluding cesses and surcharges) for domestic firms to 25%. Also, companies can carry forward losses for as long as they like, while earlier, a loss in a year could be set off against profits only within the next eight years.

In the case of foreign companies, however, in addition to this 25% tax, there will be a 15% tax on ``branch profits''. Branch profits, the code explains, are defined as total income minus corporate tax. This seems to suggest that the effective tax rate for foreign firms could actually be slightly higher than the current 35%.

Another big change is inclusion of financial assets — like shares and deposits — in the calculation of wealth tax. The whammy is sought to be offset by a reduction in the wealth tax rate from 1% to 0.25% and an increase in the threshold limit to Rs 50 crore. It's also proposed to do away with the securities transaction tax, and change the manner in which tax holidays for infrastructure industries is given.

Explaining the rationale behind these changes, the FM said: ``The aim of the direct tax code is better compliance and better realization with likely expansion in the tax base.'' He added, ``All direct tax laws have been brought under one umbrella and laid down in a manner that it will eliminate the scope of litigation.

Former FM and union home minister P Chidambaram who had begun the process of rewriting the tax laws after Budget 2005-06 said: ``It underlines the philosophy of the government, that is, a regulated free market system... The new direct tax code will promote economic activity and entrepreneurship.

The code has been put up on the finance ministry's website and the government has invited suggestions. It plans to introduce a draft bill to enact the new code in Parliament in the Winter Session.

Regulation of Journey by air (AIR INDIA) while availing Leave Travel Concession

Subject:- Regulation of Journey by air while availing Leave Travel Concession - clarification regarding.

The undersigned is directed to refer to Ministry of Finance, Department of Expenditure O.M.No. I9024/1/2009-E.lV dated 13/7/2009 modifying the O.M. No. 7(2)/E.Coord/2005 dated 23rd November, 2005 and superseding ofO.M.No. I9024/l/E.lV/2005 dated 24/3/2006.

It has been decided by the Department of Expenditure that in all cases of air travel both domestic and international where the Government of India bears the cost of air passage, the officials concerned may travel only by air India. The matter whether these orders will apply in cases of LTC has been considered in consultation with Ministry of Finance, Department of expenditure and it is confirmed that these orders/conditions will apply in cases of LTC also.

2. This issues in consultation with Ministry of Finance (Department of their ID No. 39/DS(EG)/2009 dated 20/7/2009.

Preparation and maintenance of Annual Performance Assessment Reports (APAR).

The undersigned is directed to invite the attention of the Ministries/Departments to the instructions contained in this Department's a.M. No. No. 21011/02/2009-Estt.(A) 16/02/2009 and a.M. of even umber dated 14.05.2009 on the subjects of timely preparation and proper maintenance of APAR and making the APAR transparent for representation for upgradation, if any, by the officer reported upon. The matter of preparation and maintenance of APAR has been further reviewed in this Department keeping in view the system in this regard in respect of All India ~ervices (AIS) and the undersigned is directed to convey the following decisions:-
(i) All cadre authorities shall include a box in the APAR for reflecting by the reporting officer the pen picture of the officer reported upon where the reporting officer will be required to indicate his comments on the overall qualities of the officer including areas of strengths and lesser strength and his attitude towards the weaker sections. A column will also be added in the section relating to the reviewing authority for giving the reviewing authority's remarks on the pen picture reflected by the reporting officer. There will be no other separate column in the APAR for overall assessment apart from the pen picture.
(ii) A provision may be made in the APAR in the relevant section for remarks by the reviewing officer to indicate specifically the differences, if any, with the assessment made by the reporting officer, and the reasons therefor.
(iii)Numerical grading are to be awarded by reporting and reviewing authorities for the quality of work output, personal attributes and functional competence of the officer reported upon. These should be on a scale of 1-10, where 1 refers to the lowest grade and 10 to the highest. The guidelines given in Annexure- I shall be kept in mind while awarding numerical gradings.
(iv)The format for the purpose of numerical grading in the three areas of work output, assessment of personal attributes and assessment of functional competency is in Annexure-II. For Group 'B' and 'C' officials however, suitable changes may be made by the concerned cadre authorities in the items of assessment as per functional requirements of the job and the next promotional post for them. The overall grade on a score of 1-10 will be based on 40% weightage on assessment of work output, and 30% each for assessment of personal attributes and functional competency. The overall grading will be based on addition of the mean value of each group of indicators in proportion to weightage assigned.
(v) Wherever 'accepting authority' has been prescribed in the existing system in the cadre, columns may also be provided for such authority to give his comments on the remarks of the reporting/reviewing authority and details of difference of opinion, if any, with reasons for the same. In such cases, the accepting authority will also give overall grade on a score of 1-10.
(vi) A schedule for completion of all activities relating to the APAR is given in Annexure-III.
2. The above provisions would be applicable for the APAR from the reporting year 2009-10 onwards. The concerned authorities may accordingly make necessary changes in the APAR format for numerical grading to be given by reporting and reviewing officer. This O.M. does not in any way affect the part to be filled in by the officer reported upon and other existing columns in the APAR format like attitude towards SC/ST/OBC, relations with public (wherever applicable), integrity, training requirement etc. for descriptive remarks.
3. All Ministries/Departments are requested to bring to the notice of all the offices under them for strict implementation of the above instructions.

3. Vigilance/Disciplinary case if any

In case any vig./disc.case of the type referred to in O.M.No.22011/4/91-Estt.(A) dated 14.9.92 from DOP&T circulated vide this office memo no.25-19/88-SPG dated 113.10.92 is pending against any of the officers, he should not be relived for posting without obtaining specific orders from this office. The officers against whom any punishment is current should not be promoted before expiry of currency of punishment. A report in this regard should be submitted immediately.

4. Fixation of Pay

All the officials who wish to give option for choosing date for fixation of pay under FR-22(I)(a)(1) should do so within one month from the date of assumption of charge.

5. Officers allotted out of their parent circle

The circles of allotment will immediately issue posting orders and in any case not later than 05.08.2009. In case of any difficulty in issue ofposting orders, the matter should be brought to the notice of Dte. immediately. The present circles of such officers, who have been posted to another circle on promotion, will immediately relieve the officer on receipt of posting orders, unless they submit unconditional declination.

The CPMsG of the circle of allotment /present circles will personally ensure issue of posting orders by the due date and immediate relief of the officers. Despite issuance of posting orders, if any officer does not join within one month from the date of issue of posting orders, it will be presumed that he /she has declined the promotion and this should be brought to the notice of this office immediately. If any of the officers mentioned above is not working in the circle mentioned against his/her name due to any reason, this should be brought to the notice of this office.

6. No representation regarding re-allotment from any of the officers will be entertained in any case unless he/she joins the promotional post and the request for re-allotment is recommended by the concerned Head of Circle.

7. Relevant charge reports may be sent to this office in due course.

COMPLAINTS COMMITTEE SHALL BE DEEMED AS INQUIRY AUTHORITY UNDER RULE 14 IN SEXUAL HARRASMENT CASES

Subject : CCS (Conduct) Rules, 1964 - Guidelines regarding prevention of sexual harassment of working women in the workplace.

The undersigned is directed to refer to Department of Personnel and Training O.M. No. 110,13/10/97-Estt. (A) dated 13.02:1998 and 13.07.1999, O.M. No. 11013/11/2001-Estt. (A) dated 12.12.2002 and 04.08.2005 and O.M. No. 11013/312009-Estt.(A) dated 02.02.2009 on the abovementioned subject and to say that it is necessary to have in place at all times an effective Complaint Mechanism for dealing with cases of sexual harassment of working women and to create awareness in this regard, particularly amongst working women. The salient features of the Complaint Mechanism and inquiry procedure are as follows :-

(i) Rule 3 C of the CCS (Conduct) Rules, 1964 provides that no Government servant shall indulge in any act of sexual harassment. of any women at her work place. Every Government servant who is incharge of a work. place shall take appropriate·stepste prevent sexual harassment to 'any woman at ,such work place, "Sexual harassment" includes such unwelcome sexually determined behaviour, whether directly or otherwise, as --

(a) Physical contact and advances;

(b) demand or request for sexual favours;

(c) sexually coloured remarks;

(d) showing any pornography; or /

(e) any other unwelcome physical, verbal or non-verbal conduct of a sexual nature.

(ii) Whether or: not such conduct constitutes an offence under law or a breach of the service rules, an appropriate complaint mechanism should be created in the. employer's organization. for redress of the complaint made by the victim. Such complaint mechanism should ensure time bound treatment of complaints.

(iii)The complaint mechanism should be adequate to provide, where necessary, a Complaints Committee, a special councellor or other support 'service, including the maintenance of confidentiality.

The Complaints Committee should be headed by a woman and not less than half of its member should be women Further to prevent the possibility of any undue pressure or influence from senior levels, such Complaints Committee should involve a third party, either NGO or other body who is familiar with the issue of sexual harassment.

The Complaints Committee must make an annual report to the Government department concerned of the complaints and action taken by them.

The employers and perso'n' in charge will also report on the compliance with the aforesaid guidelines including on the reports of the Complaints Committee to the Government department.

(iv) The Committee constituted for redressal of the complaints by the victims of sexual harassment should be headed by an officer sufficiently higher in rank so as to lend credibility to the investigations.

(v) The Complaints Committee, established in each Ministry or Department or Office for inquiring into complaints of sexual harassment shall be deemed to be the inquiring Authority appointed by the Disciplinary Authority and that the Complaints Committee shall hold, if no separate procedure has not been prescribed for the Complaints Committee for holding the inquiry into such complaints,the inquiry, as for as practicable in accordance with the procedure laid down in the said rules.{In 2004,a proviso was added to rule 14(2) of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 (copy enclosed) to this effect].

(vi) The Complaints Committee in terms of Cabinet Secretariat's Order No. 1 dated 26.09.2008 will inquire into complaints made against officers of the level of Secretary and 'Additional Secretary and equivalent level in the Government of India in the Ministries/Departments and Organisations directly under the control of the Central Government (other than the Central PSUs) The existing Complaints Committee established in each Ministry or Department or Office will, inquire into complaints of sexual harassment against only those Government servants who are not covered by the Cabinet Secretariat's Order NO.1 dated 26.09.2008.

(vii). It may be ensured that the Complaints Committee shall at all times be in existence and changes in its composition, whenever necessary, should be made promptly and adequately publicized. The composition of the Complaints Committee be also posted on the websites of the concerned Ministries/Departments/Offices concerned.

3. All Ministries/Departments are requested to bring the foregoing to the notice of all concerned.

PROVISIONS OF RULE 14(2) OF THE CENTRAL CIVIL SERVICES (CLASSIFICATION, CONTROL & APPEAL) RULES, 1965

14(2) Whenever the disciplinary authority is of the opinion that there are grounds for inquiring into the truth of any imputation of misconduct or misbehaviour against a Government servant, it may itself inquire into, or appoint under this rule or under the provisions of the Public Servants (Inquiries) Act, 1850, as the case may be, an authority to inquire into the truth thereof.

Provided that where there is a complaint of sexual harassment within the meaning of rule 3 C of the Central Civil Services (Conduct) Rules, 1964, the complaints Committee established in each ministry or Department or Office for inquiring into such complaints, shall be deemed to be the inquiring authority appointed.

SUB POST MASTER ARRESTED FOR SAVINGS CERTIFICATES FRAUD BY CBI

Hyderabad, July 17 (PTI) The CBI today arrested a postal department official from Warangal district in Andhra Pradesh on charge of "fraudulently" withdrawing funds to the tune of over Rs one crore deposited under different postal savings schemes.
According to CBI sources, Venu Madhav Chittempalli, a sub-post master at Godavarikhani in Karimnagar district allegedly committed the fraud through fabrication of documents of various schemes that come under Postal Savings Schemes and withdrew over Rs 90 lakh.
The accused postal official was indulged in the fraud since 2005, but the matter came to light few months ago when a woman depositor approached the post office seeking withdrawal of her deposited amount after its maturity period and found that the amount had already been withdrawn," a CBI officer told PTI.

ENHANCEMENT OF CHILD ADOPTION LEAVE FROM 135 DAYS TO 180 DAYS AND EXTENSION OF PATERNITY LEAVE (15 DAYS) TO ADOPTIVE FATHERS

Subject :- Enhancement of Child Adoption Leave from 135 days to 180 days and extension of the facility of Patemity Leave to adoptive fathers.

The undersigned is directed to refer to this Department's O.M. No. 13018/4/2004-Estt.(L) dated 31st March, 2006 regarding grant of Child Adoption Leave for 135 days to female Govemment servant on adoption of a child upto the age of one year, on the lines of matemity leave admissible to natural mothers. After implementation of the Sixth Central Pay Commission recommendations, the period of matemity leave was enhanced from 135 days to 180 days. Subsequently, this Department has received representations requesting for enhancement of the period of Child Adoption Leave from 135 days to 180 days in line with the matemity leave. The matter has been examined in this Department and it has been decided to enhance the period of Child Adoption Leave from 135 days to 180 days.

2. A female Govemment servant in whose case the period of 135 days of Child Adoption Leave has not expired on the date of issue of these orders shall also be eligible for Child Adoption Leave of 180 days.

3. It has also been decided that a male Govemment servant (including an apprentice) with less than two surviving children, on valid adoption of a child below the age of one year, may be sanctioned Patemity Leave for a period of 15 days within a period of six months from the date of valid adoption.

4. These orders shall take effect from the date of issue.

5. In so far as persons serving in the Indian Audit and Accounts Department are concemed, these orders issue in consultation with the Comptroller and Aditor General of India.

PAY BAND OF CHIEF POSTMASTERs GENERAL REVISED

The Scale of Chief Postmaster General (Rs 22400-425-24500) was revised in the 6th Pay Commission as Rs 37400-6700 (PB-4) with GP of Rs 12000/-. Principal Chief PMsG were placed in HAG+ scale (Rs 75500-80000) with 3% annual increment. Now Ministry of Finance has issued gazette dated 16.7.2009 revising the scale of Chief PMG by introducing HAG scale (Rs 67000- 79000) with 3% annual increment.

HAVE YOU RECEIVED YOUR APAR?

Department of Personnel and Training in OM No 21011/1/2005-Estt(A)(Pt-II), dated 14.5.2009 has issued orders to replace the exisiting ACR with Annual Performance Assessment Report (APAR). The full report of APAR should be communicated to the officer/official concerned with the remarks of the reporting officer and acceptance authority. This is applicable from the report for the year 2008-09.

It is learnt that in Tamilnadu Circle, the APAR has been communicated to Asst. Directors by the Chief PMG. All other officers/officials yet to receive the APARs.

It is a well known fact that DPCs are delayed only for wanting of CRs. Inefficiency in our department is generally pointed to the operating staff but the administration often forget that efficiency is also applicable to them, In most of the cases, the delay in promotin to any cadre is only because of gazetted officers who are responsible for writing and maintaining of CRs. Some of the officers are not writing CRs in time and some of them are are not capable of watching proper maintaining of CRs. The latest instruction issued as above by the Personnel Ministry will be somewhat helpful to us for getting promotion in time. The APAR for the year 2008-09 is being communicated and you will be also receiving in due course.

I want to bring to your atttention that the final assessment in the ACR (now APAR) should be any one of the following:-

(a) Outstanding (b) Very Good (c) Good (d) Average.

If any report is assessed by any other words/adjectives like satisfactory, poor etc and also if the assessment is "Average" you should appeal to the authority. If the grading is "Average", it is an adverse remark and the official/officer will not be considered for promotion. Further for MACPS (Modified Assured Career Progression Scheme) the grading should be 'Good' for promotion upto the GP of Rs 6600/- and 'Very Good' for the GP thereafter. Hence if any of the official/officer gets the remarks of "Average" (upto Group B), they should appeal to the authority within the stipulated time. i.e Fifteen days from the date of disclosure.

Further all are requested to keep the APAR in their custody so that the same may be submitted to the DPC in case of non production of APAR(s) by the administration.

Views regarding re-organisation of Sub Divisions.

All of us know that the Directorate has the proposal of manning the Sub Divisions by IPs by downgrading the sub divisions already manned by ASPs. Views/opinons were called for from all members. Dear Sir,

I share your concern over the department’s ongoing contemplation of continuing the IPs as the sub divisional heads with meager infrastructure and no official assistance. The present scenario is such that the IPs and ASPs are so much burdened with work that they hardly find time to carry out their actual work i.e. of effectively preventing the frauds by spending more time in enquiries and inspections. They have become like the students of any of those senseless schools: burdened with paperwork and whimsical targets, filled with guilt conscious when they do not accomplish the near impossible feat of writing every IR, inquiry report, periodical reviews and targets of PLI, RPLI and what nots.

Therefore in order to make qualitative improvement in the functioning of sub divisions in particular and the divisions in general the department should seriously consider the points raised by the CHQ as this is the voice of thousands of IPs and ASPs toiling hard in the fields and combating the real challenges being posed against the department.

Representation of Women Members on the various Committees/Boards concerned with selection to Posts in Central Government.

Department of Personnel & Training has given instructions to the appointing authorities to scrupulously observe the following guidlines vide Memo dated 8.7.2009:-

(i) The composition of selection Committees should be representative. It should be mandatory to have one woman member in the Selection Boards/ Committees for making recruitment to· ten (10) or more vacancies and lady candidates are expected to be available for the service / Post.

(ii) Where the number of vacancies against which selection is to be made is less than 10, no efforts should be spared in finding a lady officer for inclusion in such Committees / Boards.

(iii) In the event of such an officer not being available in the Ministry / Department itself, there is no objection to nominating lady officer from any other office at the same station.

(iv) Wide Publicity should be given tOt all appointments in Government, Advertisements should be issued in the language (s) spoken by large number of people of the State/UTs, apart from English and Hindi. Further, for Group'C' level Posts, having only basic qualifying requirements, information about vacancies for recruitment should also be disseminated through schools and colleges in that area, in addition to normal channels.

Special Provisions in the Rules and Regulations for the benefit of women employees - need to increase the representation of women in the Central Govt.

Department of Personnel Training has given detailed information about the special provisions extended to the women employees in Central Government Jobs as follows vide Memo dated 8.7.2009:-

Maternity Benefits

A female Govt. employee with less than two survlvmg children is grantedMaternity Leave for 180 days. In continuation of the maternity leave a femaleGovt. servant can also take any leave due and admissible for a period of twoyears. In case of miscarriage including abortion, the female employee isentitled to leave not exceeding 45 days* during entire service. (O.M.No.13018j2j08-Estt.(L) dated 11.9.2008 & *Notification No.13018j7 j94-Estt.(L) dated 31.3.1995).

Child Care Leave

The women employees having minor children and who have exhausted earnedleave are granted child care leave (admissible in different spells) for amaximum period of two yrs. (i.e. 730 days) during their entire service fortaking care of up to two children whether for rearing or to look after any oftheir needs like examination, sickness etc. In continu'ation of the Child Careleave, a female Govt. servant can also take any leave due and admissiblefor a period of one year. Child Adoption Leave

A female Govt. employee with less than two surviving children is granted onvalid adoption of a child below the age of one year Child Adoption Leave for aperiod of 135 days. In continuation of the Child Adoption leave a female Govt.servant can also take any leave due & admissible for a period of one year.(0. M. No.13018j4j2004-Estt. (L)dated 31.3.2006)

Special allowance to women with disability

Women employees with disabilities are paid Rs.I000j- p.m. as SpecialAllowance for child care. The allowance is payable from the time of the childbirth till the child is two yrs. old for a maximum of two children. (O.M.No.12011j04-Estt.AL) dated 11.9.2008)

Guidelines for provision of creche facility

The Govt. of India has set up day care centresj creches in Offices or majorresidential areas of the employees as a welfare measure.

Posting of husband &wife at the same station .

The Govt of India has issued detailed instructions to its offices to ensure theposting of the husband and wife at the same station so as to enable them tolead a normal family life and to ensure the education and welfare of theirchildren (O.M.No.28034j2j27-Estt-A dated 3.4.1986 & 12.6.1997.To facilitate posting of couples in the same station, it has been approved thatin case of a woman officer,whose husband is posted under the Govt. of India,the 'cooling off period may be waived up to six months so that she may get aposting at the station where her husband is posted.

Special priority for working women in allotment of residential accommodation.

The Directorate of Estates maintains a separate pool for the married/ singlewomen in Govt. house allotment.

Provision for protection of women as kept in CCS Conduct Rules, 1964.

Rule 3.3(C) of the Central Civil Services (Conduct) Rules 1964 explicitlyprohibits acts of sexual harassment of any women at her work place. For thispurpose, "Sexual Harassment" includes such unwelcome sexually determinedbehaviour, whether directly or otherwise, as

(a)physical contact and advances,

(b) demand or request for sexual favours,

(c) sexually coloured remarks,

(d)showing any pornography or

(e)any other unwelco~e physical, verbal or nonverbalconduct of a sexual nature.

The guidelines issued under the said Conduct Rules vide DOPT's O.M.No.ll013/10/97-Estt.(A) dated 13.2.1998 provide for creation of anappropriate complaint mechanism in every organisation for redressal of thecomplaints made by the victims. In terms of DOPT's O.M. No.ll013/10/97-Estt.(A) dated 13.7.1999 and O.M No.ll013/11/2001-Estt.(A) dated22.7.2003, a complaint committee should be headed by an officer sufficientlyhigher in rank than that of the complainant. As per sub-rule(2) of rule 14 ofthe Central Civil Services (Clarification, Control and Appeal) Rules, 1965 andthe instructions issued vide DOPT's O.M. No.ll013/11/2001-Estt.(A) dated4.8.2005, the report of the complaints committee shall be deemed to be aninquiry report.

Rule 13-A of the said rules says, no Government servant shall -

(a) Give or take or abet the giving or taking of dowry.

(b) Demand directly or indirectly, from the parent or guardian of a bride bridegroom, as the case may, any dowry.

Age Relaxation for appointment

Widows,divorced woman and woman judicially separated from their husbandsand who are not remarried are allowed age concession up to the age of 35years (40 years for member of SCs/STs) for posts of Group C&Dfiled throughSSC/Employment Exchange (O.M.No.15012/6/98-Estt.(D) dated 21.12.1998)

Special dispensation for women officers of North East Cadre.

All India Service lady officers borne on the North East Cadres may be allowedto go on inter cadre deputation after completion of six years of actual servicein the North East. Such lady officerswould also be eligible for deputation for amaximum of 9 years instead of five years. The lady officers would have theflexibility to utilize the maximum allowable period of inter cadre deputation intwo spells instead of one. (O.M.No.13017j 16j2003-AIS (1)dated 11.7.2006)In case of marriage between an All India Services lady officer borne on theNorth East Cadre and an officer of another Cadre, the lady officer would bemandatorily accommodated in the cadre of her spouse, if she so opts.(O.M.No.13017j 16j2003-AIS (1) dated 10.7.2006)

Change of Cadre in case of marriage of All India Service Officer

Inter cadre transfer is permitted for members of All India Service officers onmarriage to another member of All India Service where the officer or officersconcerned have sought a change. (O.M.No.13017j16j2003-AIS(1) dated8.11.2004).

2. As a part of the Action Plan of this Department approved by the Minister of State for Personnel, Public Grievances & Pensions for implementing the above commitment, this Department has already issued instructions vide a.M. No.3502112/2009-Estt.(C) dated 30th June, 2009 making it mandatory to have one woman member in the Selection Boards/Committees for making recruitment to 10 or more vacancies and where lady candidates are expected to be available for the servic~/post. under the Central Government Even where the vacancies are less than 10, no effort should be spared in including a lady officer in such CommitteeslBoards.
3. In order to ensure that adequate lady candidates are attracted to Central Government jobs and to encourage them to apply for vacancies in the Central Government, it has now been decided that all advertisements/circulars (pr recruitment to Central Government jobs should invariably mention prominently that "Government strives to have a workforce which reflects gender balance and women candidates are encouraged to apply."
4. Accordingly all MinistrieslDeptts.lRecruiting agencies are requested to ensure that all vacancies advertisements/circulars for posts in Central Government contain the above message prominently. Every effort may also be made to give wide publicity to the extent feasible about all women friendly policies and concessions/facilities available to womenempolyees in the Central Government, while making recruitment to posts in the Central Government.

Dear friends,

Sub : Re-organisatiion of Sub Divisions.

Inspite of our request, the department is not willing to make ASPs, who are gazetted officers now, as Sub Divisional heads with financial and administrative powers. The department is bent upon exploiting IP as Sub Divisional head with an intention to extract more work without any status, infrastructure and powers.

It is high time to protest against the evil design of the department. The proposal will destroy our promotional avenue and also degrade the progress of the department itself. Sufficient numbers of IPs are not available. The department is planning to merge two Sub Dns into one to suit the number of IPs. We are already burdened with more work load. All Circle heads have recommended this proposal saying that IPs are young, they will work hard and bring more business to the department. They don’t want to upgrade the grade pay of the IP, but they expect IP to work more than a BCR PA who is also drawing the same grade pay now. This is purely exploitation. We have to raise the banner.

Hence I request all CHQ Office bearers and Circle Secretaries to consult members and consider whether we can show a minimum protest by sending postcards to DG Posts objecting the proposal of making all IPs as sub divisional heads? Your reply may be sent as quickly as possible so that I will send all of you the text message to be written in the postcard.

COMPUTERISED RAILWAY TICKETS THROUGH POST OFFICES

24. Madam, I think members will be very happy to know that how the facility of UTS can be reached to the “Maa Maati Manush” . Under the MoU between Railways and Department of Post, passengers can now buy computerized tickets from nearly 5000 post offices in cities and towns. Madam, this august house would be happy to know that I have decided to introduce mobile ticketing vans “Mushkil Aasaan” for issuing reserved and unreserved tickets in both urban and rural areas. Poor people who are unable to go to the stations can now purchase tickets in market places, mohallas and other busy places. In this year, we will introduce 50 such mobile vans in the country.

Family pension to the families of officials who were appointed after 1.1.2004 and died while in service

Sub : Additional Relief on death/disability of Government servants covered by the new Defined Contribution Pension System (NPS)

The undersigned is directed to say that the pension of the government servants appointed on or after 1.1.2004 is regulated by the new Defined Contribution Pension System (Known as New Pension Scheme), notified by the Ministry of Finance (Department of Economic Affairs) vide their O.M. No 5/7/2003-ECB 2 PR dated 22.12.2003.

2. On introduction of the New Pension Scheme, among others, the Central Civil Services (Pension) Rules 1972, and the Central Civil Services (Extraordinary Pension) Rules were amended on 30.12.2003. Under the amended Rules, the benefits of Invalid Pension/Disability Pension and Family Pension/Etraordinary Family Pension/Liberalized Pensionary Award relief are not available to the Government servants appointed on or after 1.1.2004.

3. Ministry of Finance (Department of Economic Affairs) has subsequently clarified that the New Pensin Scheme is a replacement for only pension under normal circumstances and family pension in case of death of employees after retirement.

4. A High Level Task Force (HLTF) constituted by the Government has recommended certain additional benefits that can be provided on death or discharge on invalidation/disability of a Government servant covered by the New Pension Scheme. It is likely to take some time before the Rules regulating these benefits under the New Pension System are put in place.

5. Meanwhile, considering the hardships being faced by the employees appointed on or after 1.1.2004, who are discharged on invalidation/disablement and by the families of such employees who have died during service since 1.1.2004, the President is pleased to extend the following benefits to Central Civil Government Servants covered by the New Pensin Scheme, on provisional basis till furtgher orders:

(I) Retirement from Government service on invalidation not attributable to Government duty :

(i) Invalid pension calculated in terms of Rule 38 and Rule 49 of the Central Civil Services (Pension) Rules, 1972.

(ii) Retirement gratuity calculated in terms of Rule 50 of the Central Civil Services (Pension) Rules, 1972.

(II) Death in service non attributable to Government duty:

(i) Family Pensin (including enhanced family pension) computed in terms of Rule 54 of the Central Civil services (Pension) Rules, 1972.

(ii) Death Gratuity computed in terms of Rule 50 of the Central Civil Services (Pension) Rules, 1972.

(III) Discharge from Government service due to disease/injury attributable to Government Duty

(i) Disability Pensin computed in terms of the Central Civil Services (Extraordinary Pension) Rules.

(ii) Retirement gratuity computed in terms of the Central Civil Services (Extraordinary Pension) Rules read with Rule 50 of the Central Civil Services (Pensin) Rules, 1972.

(IV) Death in service attributable to Government duty:

(i) Extraordinary Family Pensin computed in terms of Central Civil Services (Extraordinary Pension) rules and Scheme for Liberalised Pensionary Awards.

(ii) Death gratuity computed in terms of Rule 50 of the Central Civil Services (Pension) Rules, 1972

The employee/his family will also be paid Dearness Pension/Dearness Relief admissible from time to time in addtion to the above benefits, on provisional basis.

6. The above provisional payments will be adjusted against the payments to be made in accordance with the Rules framed on the recommendations of the HLTF and recoveries, if any, will be made from the future payments to be made on the basis of those rules.

7. The recommendations of the HLTF envisage payment of various benefits on death/discharge of a Government employee after adjustment of the monthly annuitised pension from the accumulted funds in the NPS Account of the employee. Therefore, no payment of monthly-annuitised pensin will be made to the employee/family of the employee during the period he/she is in receipt of the provisional basis mentioned in para 5 above.

8. In case where, on discharge/death of the employee, the amount of accumulated funds in teh NPS account have been paid to the employee/family of the employee, the amount of monthly-annuitised pension from the date of discharge/death will be worked out in accordance with the rules/regulations to be notified by the Department of Financial Services/PFRDA and the same will be adjusted against the payment of benefits/relief after the notified rules in this respect are in place.

9. These instructions will be applicable to those Government servants who joined Government service on or after 1.1.2004 and will take effect from the same date i.e 1.1.2004

10. This order issues with the concurrence of Ministry of Finace (Department of Expenditure) vide thier UO No 127/EV/2009 dated 13.4.2009

Two more freighters for India Post

CHENNAI/ MUMBAI: Letters from Chennai to other metros would soon be delivered the very next day, as India Post has acquired two airplanes. From the first week of July, two aircraft bearing the logo of India Post will take off from Chennai and Mumbai. These freighters have been leased from Air India by India Post, under the ministry of communications, so that your stamped mails, sealed parcels and other expressions of sentiment can get to their destination faster than ever before. "We have been dependent on private airlines and connection flights all these years. The two dedicated aircraft will connect all metros, speeding up delivery of even ordinary mails. Now, a letter from Chennai takes up to three days to reach Delhi. Our aim is to deliver it the very next day," T Murthy, postmaster general, Tamil Nadu circle told TOI. The planes, each with a capacity of 15 tonnes, will connect cities like Chennai, Mumbai, Bangalore, Ahmedabad, Surat and Nagpur. "The aim is to have a more reliable service,'' says Manjula Parashar, chief general manager, mail business, at the postal directorate in Delhi. For this purpose, two of Air India's old Boeing 737-200s, have been converted into freighters, says Jitendra Bhargava, spokesperson of Air India. The cue for launching this service came from the success of India Post's first such aircraft which flies everything from handicrafts to foodgrain on the Kolkata-Guwahati route. As a result of this aircraft, which was launched in August 2007, birthday gifts reached the same day, businesses prospered, and the seven North Eastern sisters were brought that much closer to mainstream India. The services of this existing aircraft will be extended from next month to cover Delhi and Nagpur. Three citiesMumbai, Chennai and Kolkata will act as hubs for overnight transmission of mail. Every night before the freighters leave their centres at around 11:30 pm, all mail from nearby cities will reach them. The three Boeings will then converge at Nagpur and exchange palettes (metal sheets which carry mails sorted according to destination cities). The aircraft will then fly back with their respective palettes. When they touch down at their centres early next morning, local distribution services like trucks, trains and other airlines will take over. Dry runs for these aircraft will begin later this week.
