UOI SLP against Pre-2006 Pensioners dismissed by Supreme Court.

The Supreme Court has dismissed the SLP (Civil) 23055/2013 filed by Union of India against Delhi High Court judgement in pre-2006 pensioners casein WP 1535/2012 upholding the CAT PB judgement and Delhi High Court judgement. The above SLP came up for hearing on 29/7/2013 and the apex court dismissed the SLP on the same day. Pensioners will now get arrears w.e.f. 1/1/2006 if their revised pension was fixed at less than 50% percent of the minimum of the pay in the pay band including grade pay thereon in the revised scale corresponding  to the pre-revised pay scale from which the pensioner has retired.

JUDGEMENT :
UPON hearing counsel the Court made the following order :

“We are not inclined to interfere with the order passed by the High Court. Consequently, the special leave petitions are dismissed. However, the petitioners are at liberty to raise all points before the Tribunal as and when the appeal”.

  2. There are so many Judgements from the High Court of AP, Delhi, CAT PB etc on the same matter. The point is that serving employees as on 1.1.2006 were allowed "pay after multiplication by a factor of 1.86". This is not being done in the case pensioners who happend to retire before the crusial date of 1.1.2006. The pay scale has to be brought equal to the corresponding PB and GP. Then onlythe 50% question arises. If any OM issued by the Finance Ministry and Department of Pensioners, beore the declaration of 14th lok sabha election, one can persume that some thing is on the pipe line. Otherwise every thinhg will go with day dreams.

  6. This the high time we must unitedly fight and expose the government for indifference. They cannot stop the SC decision and CAT. What opposition politicians are doing now.Why the matter did not come up in the Parliament?

  7. Working class must unitedly fight to achieve their legitimate demand accepted by SC. CAT order must be implemented without any further delay. Why the opposition party members of the parliament did not raise the matter in parliament to implement SC order without any further delay. Pensioners have suffered lot for the past 8 to 16 years or more.

  10. revised pension arrear pre 2006 payment as early as possible because they are respected sr.citizen.so no delay to payment.

  12. Supreme Court dismissed SLP 23055/2013 on 27.9.2013.upholding the order of High Court Delhi . How many months will GOI need to comply with the order of Supreme Court ? High Court Delhi has given only 2 months The Central Government Pensioners Association should be mentally prepared to file contempt petition in case of delay.

I hope, the higher functionaries of GOI would be very considerate and positive towards the issue. In view if matter is further delayed by the union govt. it is better to file PIL under article 32 in supreme court as the pre 2006 pensioners are verge of short of life,the issue is that implementation of cabinet decession of PAY COMMISSION RESOLUTION of 1,86 formula, which is common resolution of all pay grades.The Hon'ble Supreme court constitutional Bench will consider the issue based on fag end life of pre pensionersin lakhs.

    1. It surprise to know that,the Union Govt. is filing CURATIVE PETITION against REVIEW PETITION AND CAUSING further mental tension and harassment towards senior citizens. I appeal all Senior Citizens to oppose such unhealthy process against us by approaching through Supreme Court Advocates to file PIL under Article 32,and different Articles for early settlement

    2. Finally U.P.A GOVT. given maximum injustice to senior citizens by approaching filing curative petition. U.P.A Govt. administration is worst policy against employees in all aspects. Finally the Hon'ble Supreme Court Bench dismissed the CURATIVE PETITION.Curse of our colleges who are no more with us,will effect on U.P.A cabinet and U.P.A Chairperson.

  16. Since the Hon"ble apex court verdict upkeld the verdict of P.C.A.T and given four months time to pay arrears to all pre 2006 pensioners. Kindly confirm the multification factor of 1.86 is implemented as per the 6th Pay commission resolution i,e Basic pension plus D.A / D.R multified with 1.86
