GDS Conduct & Engagement Rules 2011 : No more required


Initially there were no separate specific rules to regulate the Conduct and Discipline for GDS and their issues were decided on the analogy of rules for Whole time employees.

Rules specifically for the GDS were framed and published for the first time in DG P&T Circular No.3 dated 16.04.1935.

GDS were excluded from the, application of CCS (CCA) Rules and consequently from the ambit of the term ‘Central Civil Service, Central Civil Post’ and ‘Government Servant’ defined in the said classification rules vide SRO dated 28.02.1957.

Subsequently the said 1935 rules were repealed and P&T Extra Departmental Agents (Conduct& Service) Rules, 1959 were framed in consultation with Ministry of Law in replacement of the then existing rules as Statutory Rules.

At that time, a writ petition No.527/1957 in the matter of V Subbarayalu was filed in Madras High Court which held on 23.08.1960 that ED Agents need not be considered to be holders of civil posts and thus they would not be entitled to Constitutional protection.

Similar judgement was pronounced by Odisha High Court also on this subject. On the badis of these judgements, the Ministry of Law felt that the Statutory rules were framed on the badis of an erroneous conception about the nature of employment of ED Agents and according to these judgements , they were to be treated as non – holders of the civil post and, therefore , not within purview of Article 309& 311 of the Constitution of India.

Ministry of Law advised that non-statutory rules should be framed by repealing the statutory rules. Accordingly, non – statutory rules called ” P&T ED Agents (Conduct & Service) Rules,1964″ were framed & made effective from 10.09.1964.

Then these rules modified as GDS ( Conduct & Employment Rules), 2001.

Finally these rules modified as GDS Conduct &Engagement Rules, 2011 which are un constitutional, illegal and un natural.

So, we have to fight for the abolition of these GDS Conduct & Engagement Rules,2011.

Technology Your TV bill has changed from this month: Here’s how TRAI’s new rules impact :


TRAI’s new framework for channels and DTH providers came into effect from February 1. Though the transition was smooth and there was no blackout, the new rules require subscribers of DTH and cable to choose channels and packs. The new rules are aimed at offering “freedom of choice” to consumers and give them “direct control” on their monthly bill for television services.

With the new rules in place, subscribers can select only the channels they like. One can also remove channels they do not wish to watch from their existing channel pack. So, what impact will TRAI’s new rules have on the monthly bill of subscribers? We take a look.

Base subscription is 130 for 100 channels

The base monthly fee for 100 channels is common across all operators, which is Rs 130+18 per cent GST and it comes to around Rs 153/-. All subscribers will have to pay Rs 153 as a base fee for up to 100 channels. Those who add more than 100 channels to their pack will need to pay Rs 20 extra for 25 channels. This is the network capacity fee, which will be charged extra to the Rs 130, plus taxes.

Channel prices capped at Rs 19/-

TRAI has fixed the price of channels to Rs 19/-. However, do note that one High Definition (HD) channel counts as two Standard Definition (SD) channels so a higher price could be reflected for some channels. Several channels including from Doordarshan are free-to-air so subscribers will not need to pay for them.

Channel packs and prices

DTH providers like Airtel, Dish, Tata Sky as well as cable operators have put out individual channel prices, which are inclusive of taxes on their website.  Subscribers can choose individual channels to make their own monthly pack or choose from packs listed by providers. The curated monthly packs are based on the user’s TV patterns and the channels that they are currently subscribed to. 
Essentially, subscribers will be paying from Rs 150 plus minimum for the tier of 100 channels. For any special channels, people will have to pay extra.

Subject: – Opening of CGHS Wellness Centre (Allopathic) at Varanasi

This is for information of all eligible Central Govt. employees/ Central Govt. Pensioners, ex-MPs and other eligible stakeholders that a Central Government Health Scheme (CGHS) Wellness Centre has started functioning at Type -III Govt. Quarters 98-100 at Kendriya Colony, Bada Lapur, Sindhoura Road, Chandmari, Varanasi from 19th February, 2019 to provide comprehensive medical facilities.

The CGHS Wellness Centre (1) at Varanasi shall cover all eligible Central Govt. Employees residing within 5 km radius of the Wellness Centre and eligible pensioners and ex-MPs, etc., living in and around Varanasi as per CGHS guidelines.

The CGHS beneficiaries shall be able to avail the CGHS facilities through the Wellness Centre from 07.30 a.m. to 02.00 p.m. on all days, except Sundays and Gazzetted holidays.

The CGHS wellness Centre shall be under the administrative control of Addl Director, CGHS, Allahabad (Tel No 0532-256 0578).

'Stress' compelled officer for suicide.


Captain M. Jayantha Kumar, (PS Gr. B  officer of 2009 batch) who was on deputation from Karnataka circle to Army in 1CBPO committed suicide at his residence in the afternoon of 22/2/2019. He was 47 years old and residing at Vasant Vihar Delhi. His family is at Bangaluru. He is having two school going kids. It was told that suicide note was found near his body. Delhi police is investigating the matter under section 174 of CrPC. Prima facie it appears that he was stressed. In one page suicide note, he wrote "I am honest and innocence, but I will not allow them to misuse me anymore". I love my family. happy birthday, my son".

Captain M. Jayantha Kumar was very talented, knowledgeable, brilliant, loyal and dynamic officer. He worked as Circle Secretary for IP/ASP Association for Karnataka Circle. He passed PS Gr. B examination in the vacancy year 2009 and eagerly waiting for his regular JTS Gr. A promotion. He was the first person in the cadre who raised the issue regarding discrimination between Inspector Posts and Inspectors working in CBDT/CBEC in CWC Meeting held at Mulki (Karnataka) in the year 2005 and thereafter he alone filed OA No. 211/2007 in Hon'ble CAT Bangalore Bench. Hon'ble CAT, Bengalore Bench has disposed of this OA on 27th July 2007 with common judgement along with another OA 424/06 that  "Govt. had constituted the VI Pay Commission to set right the anomalies and to recommend Pay revision in case of Central Govt. employees, and said commission had not submitted its report at that time, and directed respondents and applicants to take up the issue immediately before the VI Pay commission for consideration with the copy of its order". His action has shown us the path to get GP Rs. 4600/- to IP cadre. As every knows that thereafter at Association level we fought and achieved the goal to get GP of Rs. 4600/- to IP cadre w.e.f. 1/1/2006. The real hero is Mr. Jayanatha Kumar. He was closely associated with IP ASP Association and always took active part at each level. He has told to his few friends that after getting regular JTS Gr. A promotion he will go back to his parent circle. 

Our heartfelt condolences to the family of the departed soul. May the soul achieve moksha. God may give sufficient strength to the family of the departed soul to bear the loss.

Centre hikes DA by 3%, to benefit 1.1 crore employees and pensioners

The decision in this regard was taken at the Union Cabinet meeting chaired by Prime Minister Narendra Modi. The hike will benefit about 48.41 lakh central government employees and 62.03 lakh pensioners.

The Union Cabinet on Tuesday increased the dearness allowance by 3 per cent effective from January 1, 2019, a move which will benefit 1.1 crore central government employees and pensioners.

The decision in this regard was taken at the Union Cabinet meeting chaired by Prime Minister Narendra Modi.

The Cabinet has approved additional DA of 3 per cent over the existing rate of 9 per cent to government employees and dearness relief to pensioners from January 1, 2019, Finance Minister Arun Jaitley told reporters after the Cabinet meeting.

The hike will benefit about 48.41 lakh central government employees and 62.03 lakh pensioners.

This increase is in accordance with the accepted formula, which is based on the recommendations of the Seventh Central Pay Commission.

GS visit to Directorate .....

Dear friends,

Yesterday (21-2-2019) visited Directorate. Met with Ms Meera Handa, DG Madam and also to seniors officers in connection with the following issues. Shri Roop Chand, President Delhi IP/ASP Association accompanied to me.
 

1. Holding of DPC for PS Gr. B cadre for the year 2017-18 & 2018-19.
 
    It was told that at least two months period is required. APARs of officers (nearly 500) who are in the zone of consideration will be called for from circles very soon.
 
2.  Cadre restructuring of Inspector Posts Cadre.
 
     The issue is very much under process and committee formed for the said purpose is working thereon. Hoping for positive outcome. It is learnt that views and comments submitted by the CHQ on 11-2-2019  will be taken in to consideration at large extent.
 
3. Inspector Posts examination for the vacancies for year 2016-17, 2017-18  (upto 31-12-2017) and 2018 (calendar year).
 
    Notification is expected in the 1st week of March 2019.
 
4. Seniority list of Inspector Posts cadre for the year 2003, to 2005.
 
     It is likely to be released by the end of this month.
 
 5. Holding of DPC for promotion to the cadre of JTS Gr. A.
   
     It is learnt that file will be sent to UPSC after finalization of gradation list of PS Gr. B cadre.

Directorate vide memo No. X-07/3/2019-SPB-II/I dated 17th January 2019 has called for information from all circles regarding preparation of combined All India Seniority List of Inspector Posts for the year 2003 to 2005 in the prescribed format by 31/1/2019, but not a single circle has submitted the requisite information to SPB-II Division of Directorate.
 
All Circle Secretaries, CHQ office bearers and IP/ASPs working in Circle Offices are directed to meet the circle administration and ensure submission of requisite information within 2 days to SPB-II division of Directorate through email adgspn@indiapost.gov.in.

Sub :  Response of the Association on recommendation of the Committee for overseeing the prospect of augmentation promotional avenue – Cadre of IP/ASP

Respected Sir,

In response to the email under reference it is to inform that the CHQ body of this Association comprising of Circle Secretaries of different Circe Branches of this Association met on 9th Feb 2019 in New Delhi and gone through the Draft Recommendation of the “Departmental Committee” on cadre restructuring of Inspector Posts Cadre  and decided to bring to your kind notice to consider the following points for active consideration with a pragmatic view.
1.   
    The CHQ has decided to propose for up-gradation of more number of PS Gr B posts from ASPs taking in to account the NFSG component instead of upgrading of PS Gr B posts to JTS since this Association has proposed up-gradation of 638 PS Gr B (including 300 NFSG Posts at Level 10) from ASP as per the proposal submitted by this Association (No. CHQ/AIAIASP/Cadre Restructuring/2016 Dated 19.09.2017 refers).

This Association urges upon to retain all the proposed upgraded posts confined to Seniority cum fitness quota only and such promotees to be allowed to be posted within the parent circle.
2.    
    What suggested in the draft recommendation by the “Departmental Committee” to restrict the promotional quota from IP line for five (5) years only that will give temporary relief obviously but immediately after expiry of five years much more number of posts of JTS will go to Direct Recruits(DR)  as long as the ratio of DP:DR = 50:50  exists in the RR of JTS.  This may be in put into ratio for DP: DR =75:25, if JTS element is enforced at all.
3.  
          No comments against para 3 of the draft recommendation of the Departmental Committee.
4.    It appears from Para 4 of the recommendation of the “Departmental  Committee” that one ASP post to be upgraded to PS Gr B post from upgraded Class- I Divisions, if enforced as per recommendation; one PS Gr- B post proposed to be upgraded from ASP from Class- I divisions having no PS Gr B post, one PS Gr-B post proposed to be upgraded in Upgraded Foreign posts and one post of PS Gr B in Circle Office as Manager(BD).

5. In the issue of proposed merger of RMS Sub Divisions made in Para 5 of the draft recommendation by the “Departmental Committee” , this Association  is of the opinion that any merger must have to be examined in view of the SIU norms.
6.    
     This Association appreciate Para 6 of the recommendation of the “Departmental Committee” for placing  the IPs in all Sub Divisions. In this context, it is also suggested to examine the re-organisation of Sub Divisions after implementation of Cadre Restructuring.
7.  
      Likewise Para 6 we appreciate the recommendation for up-gradation of all posts of In-Charge, CBS(CPC) to PS Gr B made in Para 7 of Draft Recommendation of “Departmental Committee”.

On up-gradation of CPCs, presence of ASP posts also to be considered for assistance of  the PS Gr B officers, considering the technical aspects.
8.    
    This Association appreciate the recommendation of up-gradation of In-Charge at National Speed Post Hub to Ps Gr B made at Para 8 of the Draft Recommendation of “Departmental Committee” as proposed in our said letter.   
9.    
     This Association  welcome  the recommendation of the “Departmental Committee” for their strong recommendation made in Para 9 for accepting our proposal of 10% Leave Reserve posts in IP, ASP and PS Gr B cadres.   

In view of the above this Association urges upon to take care of all the aspects as put forward by the Association with a pragmatic view and to implement the Cadre Restructuring at the earliest opportunity which has been denied decades together.
