P. Sathasivam to be new Chief Justice of India
NEW DELHI: Supreme court Judge P Sathasivam will be appointed as the next Chief Justice of India (CJI) after the expiry of present incumbent Altamas Kabir's tenure. President Pranab Mukherjee has given his nod for the appointment of Sathasivam as the next Chief Justice, official sources said. 64-year-old Sathasivam joined as a permanent judge of the Madras high court in January 1996 after which he was transferred to the Punjab and Haryana high court in April 2007. He was appointed as a Supreme Court judge on August 21, 2007. Sathasivam, who will be the 40th CJI, will have tenure till April 26, 2014. The incumbent Chief Justice retires on July 18 after having a little over nine months tenure. Kabir was appointed CJI on September 29 last year.

Subject : Guidelines regarding grant of vigilance clearance to members of the Central Civil Services/Central Civil Posts.
The undersigned is directed to refer to this Department’s O.M. of even number dated 14.12.2007 on the above subject and to say that it has been decided to modify Para 2(c) thereof as under:
"(c) Vigilance clearance shall not be withheld unless
(i) the officer is under suspension
(ii) the officer is on the Agreed List, provided that in all such cases the position shall be mandatorily revisited after a period of one year
(iii) a chargesheet has been issued against the officer in a disciplinary proceeding and the proceeding is pending
(iv) orders for instituting disciplinary proceeding against the officer have been issued by the Disciplinary Authority provided that the chargesheet is served within three months from the date of passing such order
(v) chargesheet has been filed in a Court by the Investigating Agency in a criminal case and the case is pending
(vi) orders for instituting a criminal case against the officer have been issued by the Disciplinary Authority provided that the chargesheet is served within three months from the date of initiating proceedings
(vii) sanction for investigation or prosecution has been granted by the Competent Authority in a case under the PC Act or any other criminal matter
(viii) an FIR has been filed or a case registered by the concerned Department against the officer provided that the chargesheet is served within three months from the date of filing / registering the FIR / case
(ix) the officer is involved in a trap / raid case on charges of corruption and investigation is pending."

CHQ has already brought to the notice of all Circle Secretaries, Office Bearers and Members that the issue of cadre restructuring of Inspector Posts is persistently perusing with Directorate. Directorate is likely to call us for detailed discussion on this issue and meanwhile we have to keep our proposal handy. And therefore all Circle Secretaries and office bearers were requested on 21/6/2013 to convey their views / suggestions / draft note if any on the issue to General Secretary / President on their web address within a week. Today, CHQ has received proposal from Tamil Nadu Circle. Kerala and Odisha circles have already submitted their views to General Secretary.

IP/ASP Association would like to draw your kind attention to their letters dated
31/12/2010, 22/3/2012, 21/8/2012, 20/9/2012 and 31/5/2013 on the above
captioned subject. Directorate vide memo No. 9-9/2011-SPG dated 20th
February 2013 has circulated draft seniority list of Inspector Posts for the
year 1998, 1999 and 2000 to all circles for rectification of mistakes if any.
It is confirmed from all circles that they have already rectified the omissions,
errors as directed in Directorate letter dated 20th February 2013 and
submitted their requisite report to Directorate. Odisha and Maharashtra circle have
also replied to the queries raised by Directorate.
Madam,
the combined All India Seniority List of Inspectors from the year 1998 onwards
was not prepared, released and also not placed on India Post website. This
issue was discussed with your honour on 6/2/2013 and you have assured us that,
the seniority list would be made available soon. But despite lapse of considerable
period (i.e. 4 months) the final seniority list is neither circulated nor
published on India Post website by the Department.
It is therefore fervently requested to your
kind honour to arrange for issue Combined All India Seniority List of Inspector
Posts cadre from the year 1998 onwards immediately and make it available in the
website of India Posts so that all IPs / ASPs may be aware of their seniority
position in the All India Seniority List.

India Post applies for bank licence
MUMBAI 28th June: With the Reserve Bank of India's deadline for applying for a bank licence fast approaching, the number of companies that have joined the list is rising. IndiaInfoline, Bajaj Finserv and the India Post are among the recent entities that have joined the ranks of licence seekers.
"Bajaj Finserv Ltd has submitted its application to Reserve Bank of India on June 26, 2013 for a Licence to commence banking business in terms of section 22 of the Banking Companies Act, 1949. It is proposed to do this by converting its subsidiary Bajaj Finance Ltd into a Bank in terms of RBI Guidelines for Licensing of New Banks in the Private Sector dated February 22, 2013" the company said in a statement.
"Bajaj Finserv Ltd has submitted its application to Reserve Bank of India on June 26, 2013 for a Licence to commence banking business in terms of section 22 of the Banking Companies Act, 1949. Although the postal department has been expressing its ambitions to float a bank for long, RBI would have to create a special dispensation for India Post as it does not fit into several of the criteria prescribed by the central bank. Besides the prescribed norms, the postal department would face a huge challenge in putting in place a core banking solution that would facilitate a centralized view of all its accounts. However, there are many who feel that the postal department is ideally suited to spread RBI's objectives of financial inclusion. The department already mobilizes small investments through the postal saving scheme and it has a network that is larger than any bank.
IFCI, Bajaj Finserv, India Infoline would join a host of other entities like Religare Enterprises,Aditya Birla group, JM Financial and Srei, which have lined up plans to foray into the banking sector.

The IP/ASP Association vide its
letters of even number No. dated 22/3/2012, 21/8/2012, 29th October,
2012 and 15/4/2013 requested Department to finalize the Recruitment Rules of
the Assistant Manager MMS and to conduct LDCE to fillup the vacant posts of the
said cadre.
The
post of Inspector MMS and Assistant Manager MMS were already merged with
nomenclature as ‘Assistant Manager MMS’ but fresh recruitment rules for the
post of Assistant Manager have not been framed by the Department despite above
referred reminders from this Association.
There are number of Assistant Managers posts are vacant in each and
every circle in the country and due to non framing of recruitment rules,
department has not conducted the examination for the vacant posts of Assistant
Managers.
This
Association was informed by Directorate vide letter No. 906/SR/12 dated
07/09/2012 that the said request letter was transferred to DDG (P) for
appropriate action, but till date neither
fresh recruitment rules have been framed by the Department nor examination for
filling up vacant posts of Assistant Managers in MMS has announced.
It is therefore once again requested to
your kind honour to look into this long pending issue and put on place orders
for finalization of the Recruitment Rules of the Assistant Manager MMS along
with conducting of examination for promotion for concerned eligible staff in
the cadre of Assistant Manager MMS.

Draft Seniority List of Inspector Posts for the year 1998, 1999 & 2000 issued by Directorate....an update
As all members are aware that, Directorate vide memo No. 9-9/2011-SPG dated 20/2/2013 has circulated draft Seniority List of Inspector Posts in respect of the examination conducted for the year 1998, 1999 and 2000 to all Heads of Circles for confirming the accuracy of the entries from the service record of the officer and requested to point out any mistakes found therein to Directorate. General Secretay have already issued number of reminders to Directorate for early release of senioirty list and also placed progress report in this issue on blog on 1/2/2013 and 20/6/2013.
Today, it is confirmed from Directorate that, the reply to the queries raised by Directorate on the information submitted by Odisha and Maharashtra Circle is yet not received, hence issue of final seniority list is held up. Circle Secretaries of these circles are directed to request their circle administration to settle the query immediately.

Directorate is examining the issue of cash conveyance allowance payable to GDS BPMs.
Directorate
vide their letter No. 14-03/2012-PAP dated 18/6/2013 has asked all HOCs to
intimate the average number of trips presently being made by GDS BPMs for
conveyance of cash to the Accounts Office and financial implications involved
based on such number of trips made to take review of cash conveyance allowance
payable to GDS BPMs.
It is appealed to all Sub Divisional Heads to furnish the correct and accurate information at the earliest to their divisions.

The Second Administrative Reforms Commission in its 12th Report titled "Citizen Centric Administration - The Heart of Governance", has recommended, adoption of self-certification provision for simplifying procedures. (www:darpg.gov.in)
2. Taking a cue from this some Ministries/State Governments have adopted the provision of self-certification of documents like marksheet, birth certificate etc. by the applicants/stakeholders instead of asking for an attested copy of the documents by a Gazetted Officer or filing of affidavits. Under the self attestation method, the original documents are required,to be produced at the final stage.
3. You will appreciate that the above method is citizen friendly and obtaining either an attested copy or affidavit not only cost money but also involves wastage of time of the citizens and the Government officials.
3. It is requested to kindly review the existing requirements of attested copy or affidavit in various application forms in a phased manner and wherever possible make provision for self-certification of documents, after obtaining the approval of the competent authority.

Railways to carry relief material for Uttarakhand free of cost
The Ministry of Railways has decided that relief material, viz.
food, medicines, clothes, building materials, utensils etc, will be carried to
Uttarakhand free of cost by coaching trains for a period of 15 days, i.e. from
25.06.2013 to 09.07.2013.
The relief material will be consigned to the District Magistrate of the concerned district on production of a certificate from the consignor that the consignment is a gift in kind or has been purchased with the funds donated by public for flood victims and has not been paid for by the Government or any of its agencies.
No claim for any loss or damage to consignment carried under this arrangement will be entertained unless it is clearly proved that the loss or damage took place due to willful negligence on the part of the Railways.
The relief material will be consigned to the District Magistrate of the concerned district on production of a certificate from the consignor that the consignment is a gift in kind or has been purchased with the funds donated by public for flood victims and has not been paid for by the Government or any of its agencies.

Today, General Secretary has discussed the issue of holding of DPC for the promotion to the cadre of PS Gr.B for the year 2013-14 with the competant authority and it has been told that, Directorate will issue memo soon to all CPMsG to depute their office APMG (Staff) / ADPS (Staff) again to Directorate along with the original ACRs/APARs duly completed in all respect of all senior ASPs falling within the zone of promotion for holding of PS Gr. B DPC for the year 2013-14.

DPC for promotion from PS Gr. B to JTS Gr. A for the year 2012-13 and 2013-14.
Directorate have already directed to all CPMsG to depute their office APMG (Staff) / ADPS (Staff) to Directorate along with the original ACRs/APARs duly completed in all respect of all PS Gr. B officers falling within the zone of consideration for period from 2004-2005 to 2011-12 irrespective of their date of retirement for holding of JTS Gr. A DPC for the year 2012-13 and 2013-14. It is learnt that SPG Division of Directorate is methodically scrutinizing the records in presence of officers deputed from each circle to confirm the accuracy of requisite documents required to be produce before UPSC for convening DPC. This work is said to be going on war-footing.
As we know, number of JTS Gr. A posts are vacant in each and every circle and senior PS Gr.B officer/s is/are working on ad-hoc basis since long. But nobody knows the exact vacancy position. It is therefore requested to all Circle Secretaries and office bearers of this Association to ascertain & intimate the exact number of vacancies of JTS Gr. A in their circle to General Secretary before 1/7/2013. Once DPC for promotion to JTS Gr. A cadre is over, we will definitely get more number of vacancies in PS Gr. B cadre for LDCE and DPC for 2013-14.

Furthermore, the annual ceiling of Rs 4000/- per IO/PO per year bestowed to the Head of the Circle since long is still in vogue and no action to revise this limit has been taken concomitantly leaving aside benefit granted above. However, DG Posts has the power to sanction honorarium up to Rs 5000/-, means all the cases will have to be referred to Directorate for sanction. In such cases, either the beneficiary will be deprived of his/her right or will have to wait for long to get the desired relief.

Directorate vide memo No 32016/12/2011-VP dated 04.07.2011 on the basis
of notification issued by DOP&T has revised honorarium rates for Inquiry Officers/
Presenting Officers engaged for conducting departmental enquiries which was
further revised on 8.1.2013. Under the existing structure details, minimum Rs
5000/- and Maximum 10000/- are required to be sanctioned if the enquiry is completed
within stipulated time frame. No such revision whatsoever has been made for
IO/PO for conducting GDS inquiries, perhaps this was not part of DOP&T memo
as no such cadre exists in any other department except DOP.
Although the responsibilities of IO/PO are predefined and similar in nature
both for departmental and GDS employees, yet the honorarium rate is not in
parity as is apparent from the below noted table, that also needs upward
revision at par with departmental inquiries.

However, DG Posts has the power to sanction honorarium up to Rs 5000/-, means all the cases will have to be referred to Directorate for sanction. In such cases, either the beneficiary will be deprived of his/her right or will have to wait for long to get the desired relief.
Since the
minimum rate of honorarium has been revised for departmental inquiries and the
F.R 46 B stood amended (vide MOF, DOE I.CU.O.No.4.2/5/2008-IC dated
29.01.2009), the ceiling and the Financial Powers delegated for sanction of
honorarium may also be revised suitably for all purposes.

perusing it. Directorate is likely to call us for detailed discussion on this
issue. It is therefore requested to all

Today, 46 officers have been promoted through supplementary DPC for PS Gr. B cadre and 8 PS Gr. B officers request for repatriation to their parent circle has also been considered. List will be placed on blog very shortly.

As per directions on the subject the nationalized banks are not to charge any commission on preparation of drafts favouring the PMNRF. Online contributions can also be made through the website of Prime Minister’s Office i.e. www.pmindia.nic.in.
Contributions can also be made directly in the account of Prime Minister’s National Relief Fund at the branches of the following banks: Allahabad Bank, Andhra Bank, Axis Bank, Bank of Baroda, Bank of India, Bank of Maharashtra, Canara Bank, Central Bank of India, Citi Bank, Corporation Bank, Dena Bank, HDFC Bank, ICICI Bank, IDBI Bank Limited, Indian Bank, Indian Overseas Bank, Kotak Mahindra Bank, Oriental Bank of Commerce, Punjab and Sind Bank, Punjab National Bank, Standard Chartered Bank, State Bank of India, Syndicate Bank, UCO Bank, Union Bank of India, United Bank of India, Vijaya Bank, and Yes Bank Limited.

Draft Seniority List of Inspector Posts for the year 1998, 1999 & 2000 issued by Directorate....an update
Directorate vide memo No. 9-9/2011-SPG dated 20/2/2013 has circulated draft Seniority List of Inspector Posts in respect of the examination conducted for the year 1998, 1999 and 2000 to all Heads of Circles for confirming the accuracy of the entries from the service record of the officer and requested to point out any mistakes found therein to Directorate before 20/3/2013.
It is learnt from Directorate that, the requisite information is still awaited from 2 to 3 circles. It is therefore once again requested to all the Circle Secretaries and Office Bearers to confirm the submission of information of their cirlce to Directoate. Final Seniority List will be circulated after getting reports from all Circles.
Revision of OTA rate case filled at CAT Madras Bench dismissed.
One
of the service Association has filed CAT case in Madras Bench in connection
with the revision of Overtime Allowance.
Hon’ble
CAT Madras Bench in their judgement dated 9th April 2013 stated that ''prior to 5th CPC,
all Non-Gazetted employees in receipt of monthly basic pay of upto Rs. 2200/-
were entitled to OTA for performing duties beyond the designated working hours.
The 5th CPC had recommended abolition of OTA for all categories
except the Staff Car Driver, Operational Staff and Industrial employees. But,
it recommended that the staff deployed on weekly off days should be given a
compensatory leave rather than any cash compensation in the form of OTA or
otherwise. However, the said recommendations were not accepted and status-quo
was maintained as per the recommendations of the 4th CPC. It is also
seen that the rate of OTA fixed and the ceiling by the Nodal Ministry viz.
Department of Personnel and Training, consequent on the recommendation of 4th
CPC have not been revised by the said Ministry. As rightly contended by the
respondents, unless the said Nodal Ministry approves the proposal sent by the
Department of Posts for revision of OTA rate, they are not in position to
revise the OTA rates on its own and it is a policy decision of the
Government. In other words, the
Department Posts cannot take an independent decision on the issue raised by the
respondents".
