Sub: Eligibility of children from a void or voidable marriage for family pension - clarification regarding.
The undersigned is directed to refer to this Department's O.M. No.1/16/96-P&PW (E), dated 2.12.1996 whereby it was clarified that Pensionary benefits will be granted to children of a deceased Government servant/pensioner from void or voidable marriages when their turn comes in accordance with Rule 54(8). It is mentioned in Para 4 of the O.M. that "It may be noted that they will have no claim whatsoever to receive family pension as long as the legally wedded wife is the recipient of the same."
2. The matter has been re-examined in consultation with the Ministry of Law and Justice(Department of Legal Affairs) and Ministry of Finance (Department of Expenditure). It has been decided that in supersession of Para 4 of the O.M., ibid, dated 2.12.1996, the share of children from illegally wedded wife in the family pension shall be payable to them in the manner given under sub-rule 7 (c) of Rule 54 of CCS (Pension) Rules, 1972, along with the legally wedded wife.
3. It has also been decided that in past cases, no recovery from the previous beneficiary should be made. On receipt of an application from eligible child/children of the deceased Government employee/pensioner born to an ineligible mother, a decision regarding division or otherwise of family pension may be taken by the competent authority after satisfying himself/herself about veracity of facts and entitlement of the applicant (s).
4. As regards pensioners/family pensioners belonging to the Indian Audit and Accounts Departments, these Orders issue after consultation with the Comptroller and Auditor General of India.
5. This issues with the concurrence of Department of Legal Affairs vide their FTS No. 3036, dated 17.10.2012.
6. This issues with the concurrence of Ministry of Finance, Department of Expenditure vide their I.D. No.530/E.V/2012, dated 23.11.2012.

to this Associations’ letters of even number dated 23/7/2012 (copy enclosed) and
21/9/2012 on above captioned subject.
It has already been brought to the notice of Directorate
that, as per the provision laid down in Rule 85 of POSB Manual Vol.-I,
withdrawal of Rs. 5000/- and above in all Branch Post Offices (BOs) and single
handed Departmental Sub Post Offices are to be verified by Sub Divisional Head
or Public Relation Inspectors by contacting the depositor as quickly as
possible.
SB
order No. 19/2009 dated 14/12/2009 has issued in connection with authorizing
BPMs to sanction withdrawals from Rs. 2000/- to Rs. 5000/- independently
without obtaining the prior approval of the Accounts Office and as per the
directions given under Directorate memo No. 113-11/2003-SB dated 28/9/2006 and
consequent upon the restrictions imposed by the Income Tax, all maturity
amounts above Rs. 20000/- are now being paid through cheque. In order to avoid the
cheque system the customers are seeking other options like crediting the value
into their SB accounts. This credit is normally followed by withdrawals from SB
accounts which will be, in almost cases more than Rs. 5000/-. This increases
the number of such withdrawals requiring verification as per Rule 85 of POSB
Manual Vol. I.
Directorate
is well aware that, Sub Divisional Heads have already over burdened since the
introduction of MGNREGA payments, opening of new accounts including BPL,
monitoring of CBS, procurement of PLI/RPLI business, canvassing of BD products etc. The value of
rupee is also going down day by day and the number of deposits and withdrawals
of high value are on the increase causing much work load to the sub divisional
head.
In
view of the above lines, your kind honour is once again requested to cause to
issue necessary amendment to Rule 85 of POSB Manual Vol-I by enhancing the
limit of verification of SB withdrawals from Rs. 5000/- to Rs. 30000/- at the
earliest.

CRITERIA FOR ISSUE OF PASSPORT UNDER TATKAAL SCHEME
The Government had introduced the Tatkaal scheme to issue passport to citizens in an expedited manner (after liberalizing the requirement of documents and with in the basic parameters of security consideration). The Scheme was launched on 1 January 2000 to provide a transparent and systematic avenue to applicants for issue of passports in a time bound manner, subject to production of proof of urgency. Under the scheme, passport applications are processed on post-police verification basis (where required).
The Scheme was further expanded and liberalized with effect from 23 December 2006. Now, no proof of urgency is required for out of turn fresh/re-issue of passport under Tatkaal Scheme. Similarly, no Tatkaal documentation is required for minor passport, if application falls in no Police Verification category. There was also expansion of the list of the officials authorized to issue Verification Certificate. Also the applicant has been given an option to submit the Tatkaal applications on the basis of three documents out of 16 documents (one of the three documents has to be a photo identity document).
The Government has further reduced the delivery period for issuing of passports under Tatkaal Scheme. As on today, fresh Tatkaal passports are issued within 1-7 working days of the date of application and re-issue passport under Tatkaal category within 1-3 working days, subject to completion of all formalities.
In order to further simplify the submission of passport applications, the Passport Seva Project has been successfully implemented under the National e-Governance Plan (NeGP) of the Government of India. Under this Scheme, the applicant applies on-line for submission of passport application at Passport Portal [www.passportindia.gov.in].

ADDITIONAL LTC BENEFITS TO NEWLY RECRUITED CENTRAL GOVERNMENT EMPLOYEES
Leave Travel Concession for Central Government employees in general provides for reimbursement of fare entitled to the employee and his / her family concerned for the travel to home town twice in four years or to a place any where in India in lieu of one home town travel concession once in four years.
As far as newly recruited Central Government Employees are concerned, LTC Scheme provides for some additional benefits which are discussed in this article.
LTC Scheme after implementation of Sixth Pay Commission report – Benefits to Fresh Recruits in the form of additional LTC trips.
LTC Rules amended after implementation of 6 CPC provides certain more Benefits to Fresh Recruits in the form of allowing additional home town trips under LTC (after completion of one year of continuous service in central government service)
As per the amendment made in Rule 8 of LTC Rules, Fresh recruits to Central Government may be are allowed to travel to their home town along with their families on three occasions in a block of four years and to any place in India on the fourth occasion.
This facility shall be available to the Government officers only for the first two blocks of four years applicable after joining the Government for the first time. In other words after completion of one year of continuous service in Central Government service one can avail LTC for three Home town trips and one All India trip in each of two LTC blocks that fall in in the first eight years of Government service.
The blocks of 4 years shall apply with reference to the initial date of joining the Government even though the employee changes the job within Government subsequently. The existing blocks will remain the same but the entitlements of the new recruit will be different in the first eight years of service.
After grant of this additional LTC benefits to fresh recruits, doubts were raised whether this additional benefits can be allowed Central Government Employees who have joined in the Government Service prior to 23.09.2008 (i.e. before the date of issue of OM) but yet to complete 8 years of service.
Later, DOPT clarified in this aspect to the effect that all Government servants who have not completed 8 years of service as on 01.09.2008 would be entitled for the LTC benefits available to fresh recruits.

Married and unmarried Central Government Employees can travel to home availing LTC once a year in one block of 4 years:**
This benefit was available even prior to implementation of sixth pay Commission. Under this clause, Married and unmarried Central Government Employees can travel to home availing LTC once a year in one LTC block of 4 years. There is no restriction in the form of number of years of service to avail LTC in this clause. However, this LTC for travel to home town once a year in the block of 4 years restricted to employee only. The family of the employee is not entitled LTC under this clause.
However, following conditions are to be satisfied in order to avail additional Home Town Trips in one LTC block:
1.The family of Central Government Employee should be living away from him/her at her/his home town.
2.No other LTC claim including LTC to all India and home town can be made by the employee for self and his/her family in the LTC block.
(** It is just an assumption that family of fresh recruits would usually be away from him/her at his/her home town. In fact this facility is available all central government employees whose family is at home town. There is no restriction in the form of number of years of service completed)

INDIA POSTS NEEDS A COMMITMENT.
Postal Department is attempting to regain its lost glory by implementing and monitoring its traditional services through Project Arrow and digital network that make all at every level of service accountable. Until the introduction of the courier service in the country people had no second choice than going to the Post Office to get their postal business transacted. At that time, the officers and the employees were much sincere and cooperative as far as possible in providing service to the clients. But the Post Office service began to deteriorate when the courier service landed in the country, situation further declined when instead of giving quick and better after sale service, the department officials showed one kind of lethargy, which is one of the reasons to divert the customers to the courier service.
It is complained that the post offices situated in the rural areas do not open on time. Clients here wait patiently because rural customers still do not have other option except to use Post Office. Sometimes, Post Offices are managed single handed because some of the employee do not agrees to go to the rural areas to serve. This trend was required to be checked by the officers of the department in order to give more emphasis to the rural sector where the department has potential to serve but unfortunately here the pace remain very slow. While serving the people of rural area department can generate substantial revenue from Micro Insurance and cross selling of SB accounts to MGNREGS beneficiaries. Some times in rural area, it is seen that treatment to first class mail is given to that of second class for which letters do not reach destinations in time. Sometimes, letters and parcels arriving from other post offices are not or cannot be delivered in time, which put the receivers in great anxiety. Despite these odd situation people’s hope still lie with the Post Offices over the courier so we must catch it by providing better service. Now-a-days department is using extensive technological tools. It is fact that all the departmental Post offices through out India have already been computerized and connected through WAN or broad band connectivity. Besides, there is planning to equip the Extra Departmental Branch Post Offices with ICT devices. With the continuing improvement in the quality of services through the facility of track and trace, our premium products i.e. Speed Post and EMS is contributing significantly to the revenue of the department. Increased booking of International Parcels and sale of Flat Rate Boxes can turn out to be major revenue earners for the Department.
We have post offices and a delivery system which comes in contact with every household every day. Our primary objective should therefore be to utilize the network optimally to create and provide new service without effecting core operation and traditional service. It has to be a well managed diversification. One thing that the Post Office requires is the freedom to work under such condition that it can react quickly to the demand of the customer. To address the challenge of aligning access to postal retail services with customer needs, the Postal Service has to expand access in deprived areas and squeeze its size in over served areas—but the Postal Service does not consider this criteria. If this happens it may be able to close facilities and adjust access to retail services according to customer needs.
Still it is hoped that future is likely to favour the post office if it can mobilize resources and technology to create new products and services, use its network for a variety of services and improve the way existing services are delivered. By doing so it would have also defeated the dire predictions that email would make physical mail obsolete. All that is required is a serious commitment to all managerial level in the circles, division of work by creating new jobs as is being done in banks, aggressive marketing, proper training, human resource development and close monitoring at every level to curtail the expenditure and increase the revenue resources. The officers should listen to the worker by shunning their bureaucratic approach.

Appointment on Fake Caste Certificates.
Information about appointments secured on the basis of fake/false caste certificates is not centrally maintained.
However, the Central Government had taken one time exercise to collect information about appointments secured on the basis of fake/false caste certificates in the year 2010. As per information received from various Ministries/Departments etc., 1832 appointments were allegedly secured on the basis of fake/false caste certificates. Disciplinary proceedings had been instituted in all the cases. It was reported that out of the above 1832 cases, 276 had been resulted in suspension/removal etc., whereas 521 cases were entangled into litigations and in remaining 1035 cases disciplinary proceedings were pending.
However, the Central Government had taken one time exercise to collect information about appointments secured on the basis of fake/false caste certificates in the year 2010. The Government instructions provide that an appointing authority should verify the caste status of SC/ST/OBC candidates at the time of initial appointment as well as every important upturn of the employee’s career.
Chief Secretaries of States/Union Territories have been requested to issue instructions to the District Magistrates/District Collectors/Deputy Commissioners of the Districts to the effect that when asked to verify the veracity etc. of caste certificates, they should ensure at their own level that veracity of the caste/community certificate referred to the district authorities is verified and reported to the appointing authority within one month of receipt of request from such authority. In order to rule out collusion between candidates holding false/forged certificate and employees at the district level or sub-district level, disciplinary proceedings may be initiated against officers who default in timely verification of caste status in such cases or issue false certificates.
This was stated by Shri V. Narayanasamy, Minister of State in the Ministry of Personnel, Public Grievances and Pension and Minister of State in the Prime Minister’s Office in written reply to a question by Shri Aayanur Manjunatha in the Rajya Sabha on 23/11/2012.
ID Proofs Compulsory During Train Journey in All Reserved Classes from 1st December 2012.
With effect from 01.12.2012, one of the passengers booked on a ticket for undertaking journey in any reserved class will have to produce any one of the prescribed proofs of identity failing which all the passengers will be treated as travelling without ticket and charged accordingly.
This provision shall, however, not affect the existing provision of Tatkal scheme where during the journey, the passenger is required to show the original proof of identity indicated on the ticket. The number of prescribed proofs of identity have been increased from nine to ten by adding following identity card to the list of prescribed proofs identity:- “Photo identity cards having serial number issued by Public Sector Undertakings of State/Central Government, District Administrations, Municipal bodies and Panchayat Administrations” This information was given by the Minister of State for Railways Shri Kotla Jaya Surya Prakash Reddy in written reply to a question in Rajya Sabha on 23/11/2012. The undersigned is directed to say that a number of representations have been received in the Ministry of Health & Family Welfare for recognition of Curie Manavata Cancer Centre, Nashik (Maharashtra) for treatment of Central Government Employees and their family members under CS(MA) Rules, 1944.

In view of the hardship faced by CS(MA) beneficiaries for their own treatment and the treatment of their family members at Nashik (Maharashtra), the matter has been examined in the Ministry and it has been decided to empanel Curie Manavata Cancer Centre, Nashik (Maharashtra) under Central Services (Medical Attendance) Rules, 1944.

This
Association wishes to share its concern over the LDCE system in vogue in the
department. Ever since CMC has taken over the reins of examination system of
DOP there is complete chaos and as such created mockery of the examination
system. The papers are not framed in conformity to the syllabus circulated by
the department. As a result the prospective candidates have to suffer. In the recently held Inspector Post Examination,
Paper-IV (IPO) question booklet was given an ‘option’ either to answer 50
questions of ‘General English’ or ‘General Hindi’ (Samanya Hindi) whereas it
was mentioned in the revised syllabus particularly Paper IV shall consist of
ENGLISH LANGUAGE, G.K. & REASONING /INTELLIGENCE, thereby completely excluding HINDI LANGUAGE. Obviously, the Department by explicitly
including ‘English language’ has left out ‘Hindi language’ from the ambit of
syllabus for Paper IV. In these
circumstances the prospective candidates appearing for the said examination
were naturally supposed to prepare ‘English language’ paper in accordance with
Department’s revised syllabus ignoring the ‘Hindi language (as it was omitted
and not specified in the revised syllabus). The logic of omitting the National Language ‘HINDI’
from the revised syllabus was surprising. Had there been an option either to choose
‘English language’ or ‘Hindi language in the revised syllabus, many of the
candidates would have preferred ‘Hindi language’ being more proficient in that. Inspite of the fact that the schedule
for the examination was postponed on three occasions, the Department never
realised / rectified the error crept in their circular dated 14.7.2011 omitting
‘Hindi language’. Hitherto the
department had to cancel the Paper-III of the same cadre being the law paper
out of syllabus.
It
is pertinent to mention here that when for the first time department conducted
PS Group “B” examination through outsourcing as per the revised syllabus
contained in Directorate Memo no. 9-59/2010-SPG dated 08.03.2011, this Association
raised an issue for not giving option to write paragraph in bi-lingual (Hindi
& English). At that time candidates were not allowed to write paragraph in
Hindi by the staff of CMC Ltd. at Delhi Centre whereas staff of CMC Ltd.
allowed candidates to write paragraph in Hindi at few centres like Dehradun
Centre. In UP Circle , staff of CMC Ltd. allowed the
candidates initially to write paragraph in Hindi and later on disallowed and
instructed the candidates to write paragraph in English only. Though this irregularity was brought to the
notice of department but Directorate has taken it lightly and gave not much
importance to the letter(s) of the Association, thereby given benefit to a
particular section only.
Madam, you will agree the considerable
importance attached to the provision of article 351 of the Constitution, which
prescribes development of the Hindi language. It shall be
the duty of the Union to promote the spread of the Hindi language, to develop
it so that it may serve as a medium of expression for all the elements of the
composite culture of India and to secure its enrichment by assimilating without
interfering with its genius, the forms, style and expressions used in
Hindustani and in the other languages of India specified in the Eighth
Schedule, and by drawing, wherever necessary or desirable, for its vocabulary,
primarily on Sanskrit and secondarily on other languages. Therefore, every encouragement should
be given to the use of easy and simple diction. This Association therefore suggest you that enquiry
may kindly be constituted for above chaos and the Hindi language be given its
due place. It would be fair and
appropriate if the examination work is entrusted to SSC/UPSC instead of CMC Ltd., as
has done by other departments.
