MACP Upgradation to Promotees : CAT Jodhpur Bench Judgement

The Hon CAT, Jodhpur, has delivered a historic judgement regarding granting of MACP. In its common order dated 22.05.2012 in OA 382/ 11. As per the Order, Promotion of a PA from Gr D/ Postman, should not be treated as promotion under MACP. Rather, MACP shall be granted based on the 10, 20, 30 years service in the PA cadre. Any promotions under LDCE shall not be brought into number of promotions under MACP.

APPEAL FILED IN JODHPUR HIGH COURT AGAINST CAT JUDGEMENT

Para – 9 of the Annexure – I to DOP&T OM dated 19.05.2009 provides in clearest terms that “regular service for the purpose of MACPS shall commence from the date of joining of the post in direct entry grade on a regular basis or on absorption/re-employment basis.”

The existing statutory Recruitment Rules of Postmen and PA cadre provide for promotion quota to be filled up through LDCE (Limited Departmental Competitive Examination). Para – 5 of Annexure – I of DOPT Order on MACPS provides for ignoring only the promotions/upgradations granted under the ACP scheme (old scheme) in the past to those grades which now carry the same grade pay due to merger of pay scales/up gradation of posts recommended by 6th CPC. Thus the promotions earned through LDCE are not provided to be ignored.

As per the summary record of discussions of the meeting held on 27.07.2012 with the JCM National Council Staff side on issues relating to MACPS (Annexure III to DOP&T OM No 11/2/2008-JCA dated 13.09.2012) it was decided against item No. 4 that treatment of such cases would be on the lines as was under the ACP scheme (old scheme) and Ministry of Railways would examine the matter accordingly. Para 5.1 of Annexure-I to DOP&T OM dated 09.08.1999 relating to ACP Scheme (old scheme) provides for counting of regular promotions earned through LDCE.

So far as the common Judgment of the CAT Jodhpur in OA No. 382/2011, 353/2011 and 354/2011 dated 22.05.2012 is concerned, the CAT held that whenever and official appears in LDCE and gets selected to the post, them it starts new innings for him and for the purpose of counting his stagnation, if any, from the date of joining of the new post alone would be relevant and his previous career advancement cannot be called as promotion within the definition of the word “promotion” for consideration of his eligibility under MACP scheme.

The judgment referred to above is in contradiction to the provisions of the MACPS as also against the decision of the Government against item No. 4 referred to in Annexure – III to DOP&T OM No. 11/2/2008-JCA dated 13.09.2012.

MACP Scheme is the Scheme formulated by DOP&T, the nodal Ministry in this regard. Department of Posts cannot make any change in the scheme. The Department has accordingly referred the issue to the DOP&T and provided the required Recruitment Rules as called for by the DOP&T.

Keeping in view of the existing provisions of the MACP Scheme as also the decision of the Government against item No. 4, Department has filed writ petition (Appeal) before the Hon’ble High court of Jodhpur.

Department of Official Language in the Ministry of Home Affairs, Government of India has been in the business of promoting use of Hindi in Central Government offices and organizations. Over a period of time, a number of measures have been taken to encourage increased use of Hindi in the functioning of the Government officials at the Centre. Experience has proved that a large number of officials and staff under the Central Govt. offices and organizations are keen to increasingly use Hindi for their day to day business and are not able to effectively use the language due to lack of adequate facilities. Ways and means to provide effective facilities for smooth functioning in Hindi have been considered by the Government. The idea of promoting Hindi making use of the modern technology through the electronic media has emerged as a solution to the problems faced by those who are desirous of working in Hindi and are hesitant to do so due to inadequate facilities.

Department of Official Language has entered into an Agreement with C-DAC, a computing company under the Ministry of Information and Technology to develop suitable softwares for enabling working in Hindi in Government offices an efficient and easy task. The softwares developed over the last few years include Self-learning of Hindi language (LILA series), instant translation from English to Hindi in selected domains through the MANTRA series, software for dictation in Hindi through Shrutlekhan software, software for English speech recognition and its translation into Hindi combined in one through Vachantar. The latest in the series of softwares produced in collaboration with the C-DAC by the Department of Official Language is the E-MahaShabdkosh i.e. a bilingual, bidirectional and pronouncing dictionary. It is intends to bridge the gap immensely between technology and promotion of Hindi as the Official Language. The main feature of E-MahaShabdkosh is that it is focused on the domains of Administration, Healthcare and Industry in its present form.E-MahaShabdkosh will have the following features:-

- Devanagari script depicted using UNICODE Fonts
- Pronunciations
- Clear layout, easy navigation
- Alphabetical Listing, Direct Word Search
- Search at keyword and character combinations in English/Hindi.
- Pronunciation of the Hindi word with the Speech Interface.
- Details about the variants that is usually not found in a general dictionary and carefully chosen defined accent of a language.
- Usage of the word/phrases
- Pictorial depiction (wherever applicable) of the words/phrases

2. सरकारी कार्यालयों में सरल व प्रभावी तरीके से हिंदी में कार्य करने के लिए उपयुक्‍त सॉफ्टवेयरों के विकास हेतु राजभाषा विभाग ने सूचना एवं प्रौद्योगिकी मंत्रालय की कंप्‍यूटिंग कंपनी, नामत:, सी-डैक, पुणे के साथ एक समझौता किया है । पिछले कुछ वर्षों में विकसित सॉफ्टवेयरों में हिंदी भाषा का स्‍वयं शिक्षण (लीला-श्रृंखला), मंत्रा श्रृंखला द्वारा चुने गए कार्यक्षेत्रों में अंग्रेजी से हिंदी तुरंत अनुवाद, हिंदी डिक्‍टेशन के लिए श्रुतलेखन सॉफ्टवेयर, अंग्रेजी स्‍पीच की पहचान कर उसे हिंदी में अनुवाद के लिए वाचांतर सॉफ्टवेयर शामिल है । सॉफ्टवेयरों के विकास की इस श्रृंखला में नवीनतम विकास राजभाषा विभाग द्वारा सी-डैक के माध्‍यम से ई-महाशब्दकोश का विकास है, जो कि एक द्विभाषी-द्विआयामी उच्‍चारण शब्दकोश है । ई-महाशब्दकोश के वर्तमान शुरूआती संस्‍करण में प्रशासनिक कार्यक्षेत्र में प्रयुक्‍त होने वाले शब्‍दों को शामिल किया गया है । ई-महाशब्दकोश की विशेषताएं निम्‍न प्रकार होंगी :-

Special Cover with Special Cancellation will be released on Maha Kumbha dip dates.

ALLAHABAD: To showcase the historical, mythical and spiritual significance of Prayag Maha Kumbh, Department of Posts has planned to issue Special Covers (envelopes), as a souvenir for devotees coming from across the world. Krishna Kumar Yadav Director Postal Services Allahabad Region said to make the event historical, the department will issue six special covers showcasing six important baths.

These will be released on Makar Sankranti (January 14, 2013), Paus Purnima (January 27), Mauni Amwasya (February 10), Basant Panchami (February 15), Magh Purnima (February 25) and Mahashivratri (March 10, 2013)

The design of the covers will portray the legacy of Mahakumbh and spirituality of the important holy 'shahisnans'. At the time of release of these covers.

Yadav added that special covers have been issued during Kumbh Melas earlier too, but it will be the first time they will be issued on the occasion of every important bath and devotees from across the world may take back these envelopes with them as a souvenir of Mahakumbh-2013.

Sub: Representation with the request to cancel orders issued by Southern Region, Madurai (Tamilnadu).

Respected Madam,

I am writing this letter with dismay and is extremely concerned about the arbitrary orders issued by Southern Region, Madurai to IP/ASPs (copy enclosed) to obtain and pass RPLI business procurement figures daily by each BO to the officers sitting in RO particularly our Cadre man over phone after duty hours without going through the veracity of the problems being faced by our members and their family liability.

Madam, you know that department is implementing all long lasting projects like Digitization of records, Core Banking, Mail optimization, Consumer Price Index, Aadhaar Technology, Direct Cash Transfer, CTS etc etc.... with the intense and hard work of IP cadre. This is done beside our routine work as such our cadre is already overburdened.  It is not understood what the officers sitting at the helm of affairs purport to represent. If officers are so much concerned about the well being of the department it would be appropriate for them to visit BOs/SOs for the business, to analyse and assess the customer needs particularly emphasising the rural segment.

Whereas Inspector cadre is made to meet capricious and discrimination treatment in all sphere viz financially, officially and socially in postal set up. None of our demand may it be Grade Pay issue, Supplementary DPC, Regular DPC has been settled in time by the department leaving us staggered and treating this hardworking cadre as criminals. Even after acquiring long years of experience and expertise, IP/ASPs are forced to retire in the ASP cadre due to ineffective policies and dilatory attitude of the department and no one in Directorate is asking the officers there to work overtime for convening regular DPC within the prescribed norms, which is otherwise essential and necessary to implement the instructions of Nodal office, DOPT guidelines.

Furthermore, it is imperative to say that long working and inadequate breaks not only affect a worker’s productivity but also invites long term health problems of the workers.  Long working hours also impact a worker’s family life and as a consequence, his or her right towards a family and the life associated with it, which is totally violative of labour laws, while on the other hand officers enforcing such arbitrary instructions are enjoying themselves with their families. This cadre also want the same honour, dignity, moral imperatives and ethical value precedence as other possess.

I therefore request your kind honour to intervene and set aside the arbitrary order issued by Southern Region, Madurai else call expert advice from an officer who can provide honest and accurate picture of the current situation prevailing in the department due to overlooking the rights of IP/ASP or may the National Human Right Commission be requested to have an in depth research. Department should not expect much from IP/ASPs who are in the GP of Rs.4200/4600 which even the clerical staff is enjoying with extra benefits.

A ray of help for justice to bailout this depressed cadre is requested.

Review of Existing Laws on Safety of Women Justice verma Committee Invites Suggestions from Public

The recent incident of rape and brutal assault on a young woman in Delhi has shaken the conscience of the nation and has triggered a serious debate amongst jurists, civil society members and women’s groups about inadequacy of the present laws to protect the safety and dignity of women.

The Government has given anxious consideration to the need for reviewing the present laws so as to provide for speedier justice and enhanced punishment in cases of aggravated sexual assault. For that purpose, a Committee has been constituted by the Union Government on 23.12.2012 under the Chairmanship of Justice (Retd.) Shri J.S. Verma, former Chief Justice of India. The other two Members are – (i) Justice Smt. Leila Seth, former Chief Justice of Himachal Pradesh High Court (ii) Shri Gopal Subramanian, former Solicitor General of India, former Chairman of Bar Council of India and eminent Jurist.

The Committee has to submit its Report within 30 days. The public in general and particularly the eminent jurists, legal professionals, NGOs, Women’s Groups and civil Society members are requested to share with this Committee their views, knowledge and experience suggesting possible amendments in the criminal laws and other relevant laws to provide for quicker investigation, prosecution and trial as also enhanced punishment for criminals accused of committing sexual assault of extreme nature against women.

The suggestions should be sent by January 05, 2013 so as to enable the committee to complete its task and give its report with necessary recommendations within the available time.

DOP requested MOF for exemption for abolishing of vacant posts of 2005 to 2008.

Department of Posts has already abolished 2/3rd vacant posts from 2001 to 2004. Now, 2/3rd vacant  posts for the year 2005 to 2008 to be abolished.  DOP has requested Ministry Finance to grant exemption to Department of Posts from abolishing the vacant posts from 2005 to 2008, as it is an operative Department dealing with the general public and customers.  These posts are kept  vacant (but not abolished) pending decision of the Ministry of Finance.

The ban on recruitment was lifted and the Screening Committee was abolished in the year 2009.  Government of India issued orders to fill up all vacant posts for the year from 2009 onwards.  Accordingly, Department of Posts, issued orders to fill up all vacancies for the year 2009 and 2010.  Orders are also issued to fill up all vacant posts for the year 2011 and 2012.  But, at the same time, Directorate issued clear instructions to all Chief PMsG that posts kept vacant for the year from 2005 to 2008 should not be filled up under any circumstances but should be kept vacant (for abolition).
